SRC-TBR S.B. 1373 77(R) BILL ANALYSIS Senate Research Center S.B. 1373 77R4709 JAT-DBy: Moncrief Health & Human Services 3/28/2001 As Filed DIGEST AND PURPOSE Currently, the Texas Board of Health (board) is allowed to accredit food protection education and training courses. As proposed, S.B. 1373 requires the board to establish the course content required for the accreditation and training programs for food service workers. The bill also requires such students to take a department approved examination to assist the department in evaluating the program. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Board of Health in SECTION 1 (Section 438.043, Health and Safety Code) of this Act. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 438.043, Health and Safety Code, as follows: (a) Requires that the Texas Board of Health (board) by rule to establish the course content required for accreditation of education and training programs for food service workers under Sections 438.042(a) and (b). Deletes language regarding training program requirements. (b) Requires the Texas Department of Health (department), in addition to the course requirements in Subsection (a), to require students of a program to take an examination approved by the department to assist the department in evaluating the program. Deletes language regarding training program requirements. SECTION 2. Amends Section 438.046(b), Health and Safety Code, to delete language regarding a food worker training course for a single entity. SECTION 3. Repealer: Section 438.042(b) (Duties of Board), Health and Safety Code. SECTION 4. Effective date: September 1, 2001.
