SRC-CTC S.B. 1374 77(R) BILL ANALYSIS Senate Research Center S.B. 1374 2001S0754/1By: Moncrief Business & Commerce 4/2/2001 As Filed DIGEST AND PURPOSE Currently, state law allows liens for aircraft storage, repairs, and maintenance work, but not for fueling an aircraft. As proposed, S.B. 1374 gives fuel vendors the same legal rights for liens on the owner of an aircraft who has not paid fueling charges as those who store or repair aircrafts. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 70.301(a), Property Code, to provide that a person who, among other things, fuels an aircraft has a lien on the aircraft for the amount due under a contract for the fuel, or, if no amount is specified by contract, the reasonable and usual compensation for the fuel. SECTION 2. Amends Section 70.303, Property Code, to make a conforming change. SECTION 3. Amends Section 70.304, Property Code, to make a conforming change. SECTION 4. Amends Section 70.305, Property Code, to make a conforming change. SECTION 5. Effective date: September 1, 2001. Makes application of this Act prospective.
