SRC-JBJ S.B. 1380 77(R) BILL ANALYSIS Senate Research Center S.B. 1380 77R8140 GWK-FBy: Armbrister Criminal Justice 3/16/2001 As Filed DIGEST AND PURPOSE Currently, Texas statutes do not completely conform to the federal Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act pertaining to the lifelong registration of sexual offenders. As proposed, S.B. 1380 amends provisions pertaining to lifelong registration to include individuals who, having a previous conviction for a reportable offense, commit certain offenses, including indecency with a child without contact; unlawful restraint of a child; kidnapping of a minor; and aggravated kidnapping without intent to sexually abuse. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 62.12(a), Code of Criminal Procedure, to provide that the duty to register for a person ends when the person dies if the person has a reportable conviction or adjudication for certain specific offenses under certain conditions. SECTION 2. Provides that the change in law made by this Act applies to a defendant with a reportable conviction or adjudication for an offense or conduct under Section 21.11(a)(2), Penal Code, that was committed before, on, or after the effective date of this Act, and a defendant with a reportable conviction or adjudication for an offense or conduct under Section 20.02, 20.03, or 20.04, Penal Code, that was committed on or after September 1, 1999. SECTION 3. Effective date: September 1, 2001.
