"Buster" Business & Commerce 3/28/2001 Committee Report (Substituted) DIGEST AND PURPOSE Currently, there is no general provision allowing a suit alleging a violation of the Texas Insurance Code to be brought in Travis county. C.S.S.B. 1391 allows a suit involving any violation of the Texas Insurance Code to be brought in Travis County. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 21E, Insurance Code, by adding Article 21.29, as follows: Art. 21.29. VENUE FOR ACTION ALLEGING VIOLATION OF INSURANCE LAW. Authorizes an action alleging a violation of this code or any other insurance law of this state to be filed in a district court in Travis county, notwithstanding any other law regarding revenue SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001. SUMMARY OF COMMITTEE CHANGES Amends As Filed S.B. 1391, Chapter 21E, Article 21.29, Insurance Code, to authorize that any action alleging a violation of any other insurance law of this state rather than merely of this code, to be filed in a Travis County district court.
