SRC-JBJ C.S.S.B. 1413 77(R) BILL ANALYSIS Senate Research Center C.S.S.B. 1413 77R13176 JMC-DBy: Lindsay Criminal Justice 4/19/2001 Committee Report (Substituted) DIGEST AND PURPOSE Under current Texas law, a hospital that has treated a crime victim is allowed to submit an invoice to the Crime Victims Compensation Fund in an amount up to $50,000 for compensation for those services. C.S.S.B. 1413 increases that amount from $50,000 to $100,000. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 56.42(a), Code of Criminal Procedure, to prohibit awards payable to a victim and all other claimants sustaining pecuniary loss because of injury or death of that victim, except as otherwise provided by this article, from exceeding $100,000, rather than $50,000, in the aggregate. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001. SUMMARY OF COMMITTEE CHANGES Differs from the original by amending the relating clause. SECTION 1. Differs from the original by removing the previously proposed addition of new Article 56.42(e) and adding an amendment to existing Article 56.42(a). Adds a new SECTION 2 providing for the prospective application of this Act and renumbers previously proposed SECTION 2 as SECTION 3 with no change.
