SRC-MWN S.B. 1414 77(R) BILL ANALYSIS Senate Research Center S.B. 1414 77R6962 AJA-FBy: Lindsay Natural Resources 4/2/2001 As Filed DIGEST AND PURPOSE Currently, Section 552.022, Government Code, contains the Public Information Act and provides in part that a completed report is not excepted from required public disclosure unless it is confidential under other law. As proposed, S.B. 1414 makes information relating to the location or purchase or sale of real property by the state temporarily confidential, until such time as the formal award of the contract for the property is executed. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 11D, Water Code, by adding Section 11.084, as follows: Sec. 11.084. CONFIDENTIALITY OF CERTAIN INFORMATION RELATED TO PURCHASE OR SALE OF REAL PROPERTY. (a) Provides that information relating to the location, purchase price, or sale price of real property purchased or sold by or for certain entities under authority granted by this code is confidential and exempt from disclosure under Chapter 552 (Public Information), Government Code, until a formal award of a contract for the purchase or sale of the property is executed. Provides that information that is confidential and exempted from disclosure includes certain conditions for the purpose of locating or determining the purchase or sale price of the property. (b) Provides that information that is confidential and excluded from disclosure under Subsection (a) is not subject to a subpoena directed to certain entities. SECTION 2. Effective date: upon passage or September 1, 2001.
