DIGEST AND PURPOSE 

Currently, the Office of Defense Affairs (ODA) is under the Texas
Department of Economic Development and reports directly to the executive
director of that department.  As proposed, S.B. 1425 transfers ODA, with
all powers and duties, to the Office of the Governor, requires ODA to
report directly to the governor, and requires the governor to provide
administrative support to ODA. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 481.0065, Government Code, by transferring it to
Title 4C, Government Code, redesignating it as Chapter 436, Government
Code, and amending it as follows: 

CHAPTER 436.  OFFICE OF DEFENSE AFFAIRS

 Sec. 436.001.  DEFINITION.  Defines "state agency."

Sec. 436.002.  OFFICE OF DEFENSE AFFAIRS.  Requires the governor, rather
than the Texas Department of Economic Development (department), to perform
certain requirements. Requires the Office of Defense Affairs (ODA) to
report directly to the governor. 

Sec. 436.003.  POWERS AND DUTIES.  Adds new section number and heading to
existing text. 

Sec. 436.004.  ANNUAL REPORT.  Adds new section number and heading to
existing text and makes conforming changes. 

Sec. 436.005.  DATABASE OF DEFENSE CONTRACTORS.  Adds new section number
and heading to existing text. 

Sec. 436.006.  ANNUAL MEETING.  Adds new section number and heading to
existing text and makes a conforming change. 

Sec. 436.007.  CONSULTING AGREEMENTS.  Adds new section number and heading
to existing text. 

Sec. 436.008.  ADMINISTRATIVE SUPPORT.  Requires the governor to provide
administrative support to ODA.   

SECTION 2.  Effective date: September 1, 2001.
