SRC-MWN S.B. 1443 77(R) BILL ANALYSIS Senate Research Center S.B. 1443 77R2846 CAS-DBy: Van de Putte Education 4/23/2001 As Filed DIGEST AND PURPOSE Currently, the powers and duties of the boards of trustees and superintendents of independent school districts lack conforming statute language. As proposed, S.B. 1443 establishes in statute the powers and duties of school district boards and superintendents. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.051(a), Education Code, to prohibit a member of the board of trustees (board) of a school district, from acting individually on behalf of the board. Authorizes the board to act only by majority vote. SECTION 2. Amends Chapter 11D, Education Code, by adding Sections 11.1511 and 11.1512, as follows: Sec. 11.1511. SPECIFIC POWERS AND DUTIES OF BOARD. (a) Sets forth provisions of the powers and duties of the board. (b) Requires and authorizes the board to perform certain duties or procedures. Sec. 11.1512. COLLABORATION BETWEEN BOARD AND SUPERINTENDENT. Requires the board and the superintendent of the district to work together in certain areas. SECTION 3. Redesignates Section 11.163, Education Code, as Section 11.1513, Education Code, and amends it as follows: Sec. 11.1513. EMPLOYMENT POLICY. (a) Requires the employment policy to provide certain information. (b) Authorizes the board to accept or reject the superintendent's recommendation regarding the selection of district personnel but prohibits it from arbitrarily rejecting that recommendation. SECTION 4. Amends Section 11.201(d), Education Code, to set forth additional duties of the superintendent. SECTION 5. Amends Section 11.159(b), Education Code, to provide that the minutes of the last regular meeting of the board held during a calender year to is required to reflect whether each board member has met the State Board of Education's training requirements. SECTION 7. Effective date: September 1, 2001.
