DIGEST AND PURPOSE 

Currently, diabetes is a significant problem in Texas; juvenile diabetes is
of particular concern. C.S.S.B. 1456 establishes a pediatric diabetes
research advisory committee to research pediatric diabetes and medical
conditions associated with diabetes, assess state institutions as possible
sites for research opportunities, analyze the impact of diabetes on the
economy and public health, and make recommendations to state officials
concerning research programs and funding options. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.  

SECTION BY SECTION ANALYSIS

SECTION 1.  (a)  Requires the commissioner of public health (commissioner),
in consultation with the Texas Diabetes Council, to establish a pediatric
diabetes research advisory committee (committee).   

 (b)  Sets forth the composition of the committee.

(c) Requires the commissioner to select members of the committee based on
certain experience, expertise, or special interests. 

(d) Requires the commissioner, with recommendations from the Texas Diabetes
Council, to select a member of the committee to serve as the presiding
officer.  Prohibits the presiding officer from being an officer or employee
of the state. 

(e) Requires the committee to: develop a plan to research pediatric
diabetes and medical conditions associated with diabetes in this state;
assess the resources and talent of state institutions as possible research
sites; analyze the impact of diabetes on the  state economy and the health
of the residents of the state; and make recommendations to the legislature
and governor concerning research programs in pediatric diabetes and funding
alternatives for the programs. 

(f) Requires the committee to meet at least four times as determined by the
presiding officer. Requires a professional facilitator with experience in
strategic planning to facilitate meetings of the committee. 

(g) Prohibits a member of the committee from receiving compensation for
service on the committee; however, entitles a member of the committee to
receive reimbursement for reasonable and necessary travel expenses incurred
by the member while conducting committee business. 

(h) Requires the commissioner to submit a report prepared by the committee
to the governor, lieutenant governor, and speaker of the house of
representatives regarding pediatric diabetes  that comprehensively
addresses the issues listed in Subsection (e) not later than December 1,
2002. 

SECTION 2.  Requires the commissioner to appoint the committee members not
later than the 90th day after the effective date of this Act. 

SECTION 3.  Abolishes the committee as of January 1, 2003.

SECTION 4.  Provides that this Act expires September 1, 2003.

SECTION 5.  Effective date: upon passage or September 1, 2001.

_omitting the short title and legislative findings;

_restructuring and clarifying the text of the bill;

_requiring the submission of a committee report to the lieutenant governor
and speaker of the house of representatives in addition to the governor,
omitting the legislature from the list of report recipients, and giving a
deadline for the report; and 

_including specific dates for the abolition of the committee, the
expiration of this Act, and the effective date of this Act.
