DIGEST AND PURPOSE 

Currently, new instructional facilities receive an allotment of $250 per
student in average daily attendance for the first school year in which
students attend the new facility, and the total allotments for new
facilities is capped at $25 million per year.  These funding levels are
insufficient to adequately offset the extraordinary costs for equipment and
other operating expenses associated with opening new campuses.  As
proposed, S.B. 1461 increases the amount allotted per student in average
daily attendance to $500 and removes the $25 million appropriations cap. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 42.158, Education Code, to increase the
allotment a school district is entitled to for each student in average
daily attendance for the first school year in which students attend a new
instructional facility from $250 to $500.  Deletes existing text relating
to the maximum allotments allowed under this section.  Makes a conforming
change. 

SECTION 2.  Effective date: September 1, 2001.
