SRC-CTC S.B. 1472 77(R)BILL ANALYSIS Senate Research CenterS.B. 1472 By: Ogden Education 5/31/2001 Enrolled DIGEST AND PURPOSE Currently, institutions of higher education are required to collect a property deposit fee of up to $10 from all students. These institutions must maintain proper records throughout the student's attendance, and refund the fee upon request from students who graduate or cease to enroll at the institution. Realistically, $10 does not provide much insurance against losses or damages to university property. S.B. 1472 increases the authorized property deposit fee from $10 to $100 and makes the collection of the fee optional. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 54.502(a), Education Code, to authorize, rather than require, an institution of higher education to collect a reasonable deposit in an amount not to exceed $100, rather than $10, from each student to insure the institution against losses, damages, and breakage in libraries and laboratories. Requires the deposit to be returned on withdrawal or graduation of a student, less an amount necessary to cover any loss, damage, or breakage caused by the student. SECTION 2. Effective date: upon passage or September 1, 2001.
