HBA-BSM S.B. 1491 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1491 By: Shapleigh Elections 5/6/2001 Engrossed BACKGROUND AND PURPOSE Under current law, early voting clerks are required to maintain and update a roster daily that lists each person who votes an early voting ballot by personal appearance participation. However, there may be some concern that the immediate posting of the roster may conflict with the open records law which allows for a delay of up to 10 days before requested records are released. Senate Bill 1491 specifies that personal appearance early voting rosters are required to be made available for public inspection not later than the beginning of regular business hours the day after the information is entered on the roster. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1491 amends the Election Code to provide that information on the early voting roster for a person who votes an early voting ballot by personal appearance is required to be made available for public inspection not later than the beginning of regular business hours on the day after the date the information is entered on the roster. EFFECTIVE DATE September 1, 2001.
