DIGEST AND PURPOSE 

Certain reports or statements submitted to the  Commission on Law
Enforcement Officer Standards and Education (commission) are confidential
and are not subject to disclosure under Chapter 552 (Public Information),
Government Code.  S.B. 1583 provides that those documents are confidential
unless they involve substantial incidents of excessive force or violations
of the law other than traffic offenses. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 1701.454(a), Occupations Code, to provide that a
report or statement submitted to the Commission on Law Enforcement Officer
Standards and Education (commission) under this subchapter is confidential
and is not subject to disclosure under Chapter 552 (Public Information),
Government Code, unless the person resigned or was terminated due to
substantiated incidents of excessive force or violations of the law other
than traffic offenses. 

SECTION 2.  Effective date: September 1, 2001.
