SRC-BWC S.B. 1589 77(R) BILL ANALYSIS Senate Research Center S.B. 1589 77R4556 JRD-DBy: Moncrief Criminal Justice 3/26/2001 As Filed DIGEST AND PURPOSE Currently, the Juvenile Probation Commission (JPC) is included as an agency under the Health and Human Services Commission (commission). However, JPC has limited health and human services (HHS) interactions and works closely with only a couple of HHS agencies. JPC is subject to numerous policy and operational requirements implemented by the Health and Human Services Commission for the group of HHS agencies. Further, JPC finds that it must attend numerous meetings that affect HHS agencies that are not relevant to JPC except for their oversight attachment to the commission. As proposed, S.B. 1589 removes JPC from the Health and Human Services Commission umbrella. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 531.001(4), Government Code, as amended by Chapters 7 and 1460, Acts of the 76th Legislature, Regular Session, 1999, to delete the Texas Juvenile Probation Commission from the list of Health and Human services agencies. SECTION 2. Amends Section 2166.553(b), Government Code, to change a reference from the "Texas Commission for the Deaf and Hearing Impaired" to the "Texas Commission for the Deaf and Hard of Hearing." Makes a conforming change. SECTION 3. Amends Section 132.003(b), Human Resources Code, to make conforming changes. SECTION 4. Repealer: Section 141.0405 (Powers and Duties of Commissioner of Health and Human Services), Human Resources Code. SECTION 5. Effective date: September 1, 2001.
