SRC-MWN S.B. 1609 77(R) BILL ANALYSIS Senate Research Center S.B. 1609 77R7723 JAT-DBy: Staples Natural Resources 4/27/2001 As Filed DIGEST AND PURPOSE Currently, residents of a residential subdivision are prohibited from consolidating greenwaste for on-site burning at one location within the subdivision. As proposed, S.B. 1609 authorizes residents of a subdivision to consolidate their greenwaste to be burned at one location within the subdivision. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Natural Resource Conservation Commission in SECTION 1 (Section 382.018, Health and Safety Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 382.018, Health and Safety Code, to require the Texas Natural Resource Conservation Commission (commission) by rule to authorize residents of a residential subdivision to consolidate for on-site burning at one location within the subdivision and to burn at that location waste from individual residents' properties that consist of trees, brush, and other plant growth. SECTION 2. Effective date: September 1, 2001.
