SRC-JEC S.B. 1631 77(R) BILL ANALYSIS Senate Research Center S.B. 1631 By: Bernsen Intergovernmental Relations 4/18/2001 As Filed DIGEST AND PURPOSE Currently, a home-rule municipality is authorized to define and order abatement of a nuisance within 5,000 feet of the city limits. As proposed, S.B. 1631 extends this authority to a general law municipality, within 2,500 feet of the city limits. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 217.002, Local Government Code, to authorize a governing body of a municipality to define and declare what constitutes a nuisance and authorize and direct the summary abatement of the nuisance within the limits of the municipality and within 2,500 feet of the limits. SECTION 2. Effective date: September 1, 2001.
