SRC-JBJ S.B. 1665 77(R) BILL ANALYSIS Senate Research Center S.B. 1665 77R9447 GWK-FBy: Armbrister Criminal Justice 4/23/2001 As Filed DIGEST AND PURPOSE Under current Texas law, there are certain procedures and criteria for the expunction of criminal records. As proposed, S.B. 1665 allows for the expunction of the record of certain misdemeanor offenses under certain conditions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 55.01, Code of Criminal Procedure, by adding Subsection (d), to require a district court under certain conditions to expunge under the procedure established under Article 55.02 of this code all records and files relating to the arrest of a person for the commission of an offense punishable as a misdemeanor. SECTION 2. Provides that the change in law made by this Act applies to a defendant seeking expunction of records relating to an arrest regardless of whether the arrest occurred before, on, or after the effective date of this Act. SECTION 3. Effective date: upon passage or September 1, 2001.
