HBA-CMT S.B. 1677 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1677 By: Jackson Land & Resource Management 5/4/2001 Engrossed BACKGROUND AND PURPOSE Currently, many coastal subdivision restrictions are antiquated and need to be updated to include adequate provisions for maintenance fees and certain assessments. Senate Bill 1677 amends the applicability of provisions governing the powers of property owners' associations to make restrictive covenants in certain subdivisions. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1677 amends the Property Code to provide that provisions pertaining to the powers of property owners' associations relating to restrictive covenants in certain subdivisions apply only to residential real estate subdivisions excluding a condominium development that are located in whole or in part in a county with a population of three million or more or in a county with a population of 250,000 or more that is adjacent to a county having a population of three million or more and that borders the Gulf of Mexico rather than in a county with a population of 2.8 million of more. EFFECTIVE DATE September 1, 2001.
