SRC-JEC S.B. 1677 77(R) BILL ANALYSIS Senate Research Center S.B. 1677 By: Jackson Intergovernmental Relations 3/23/2001 As Filed DIGEST AND PURPOSE Currently, many coastal subdivision restrictions are antiquated and need to be updated to include adequate provisions for maintenance fees and certain assessments. As proposed, S.B. 1677 decreases the population requirement of a county to allow residents of a larger number of counties to amend the subdivision restrictions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 204.002(a), Property Code, to provide that this chapter applies only to a residential real estate subdivision, excluding a condominium development governed by Title 7, that is located in whole or in part in a county with a population of 200,000, rather than 2.8 million, or more. SECTION 2. Effective date: upon passage or 90 days after adjournment.
