SRC-SEW S.B. 1680 77(R) BILL ANALYSIS Senate Research Center S.B. 1680 77R9041 SGA-DBy: Jackson Natural Resources 4/2/2001 As Filed DIGEST AND PURPOSE Under current law, each navigation district is allowed to set aside five percent of its revenue each calendar year in a promotion and development fund for expenses incurred in promoting and developing business for the port or waterway operated by the district. Currently, a county auditor is prohibited from auditing disbursements from such a fund. As proposed, S.B. 1680 authorizes a county auditor to audit disbursements from a navigation district's promotion and development fund in order to ensure that the fund is used responsibly and in accordance with its intended purpose. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 60.204(c), Water Code, to authorize the county auditor to audit disbursements from the fund, rather than prohibit the auditor from doing so, and to require the county auditor to be entitled to a certain monthly statement. SECTION 2. Effective date: upon passage or September 1, 2001.
