DIGEST AND PURPOSE 

The Texas Constitution authorizes the creation of groundwater conservation
districts to plan, develop, and regulate the use of water. As proposed,
S.B. 1704 creates the Southeast Trinity  Groundwater Conservation District,
subject to approval at a confirmation election, to manage  groundwater
resources. 

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the board of directors of the
Southeast Trinity Groundwater Conservation District in SECTION 5 of this
bill. 

SECTION BY SECTION ANALYSIS

SECTION 1. RATIFICATION OF CREATION. Ratifies the creation of the Southeast
Trinity Groundwater Conservation District. 

SECTION 2. DEFINITIONS. Defines "board," "commission," and "district."

SECTION 3. BOUNDARIES. Sets forth provisions regarding the boundaries of
the district. 

SECTION 4. FINDINGS RELATIVE TO BOUNDARIES. Provides findings regarding
boundaries and field notes of the district. 

SECTION 5. GENERAL POWERS. Sets forth general powers of the district.

SECTION 6. BOARD OF DIRECTORS. Sets forth provisions regarding the
composition of the district's board of directors. 

SECTION 7. METHOD OF ELECTING DIRECTORS: COMMISSIONERS PRECINCTS. Sets
forth provisions regarding the election  and eligibility of district
directors. 

SECTION 8. CONFIRMATION ELECTION AND ELECTION OF INITIAL DIRECTORS. Sets
forth provision regarding the confirmation and duties of the initial board
of directors. 

SECTION 9. ELECTION OF REGULAR DIRECTORS. Sets forth provisions regarding
the election of regular directors. 

SECTION 10. COORDINATION. Authorizes the district to coordinate certain
activities with other districts. 

SECTION 11. MODIFICATION OF DISTRICT. Authorizes the district to be
modified according to certain provisions. 

SECTION 12. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS. Sets forth that
the  intentions of this Act have been published and notice has been
furnished to certain persons or entities. 


SECTION 13. EFFECTIVE DATE; EXPIRATION DATE. September 1, 2001.
                        Provides that the district is dissolved if it has
not been confirmed at an election                              before
September 1, 2005.
