SRC-MWN S.B. 1738 77(R) BILL ANALYSIS Senate Research Center S.B. 1738 By: Cain Natural Resources 4/18/2001 As Filed DIGEST AND PURPOSE The Texas Natural Resource Conservation Commission (TNRCC) currently establishes minimum standards for on-site sewage systems. However, the present statute currently prevents many local governments from adopting more stringent standards. As proposed, S.B. 1738 clarifies that local governments are authorized to adopt more stringent standards to regulate on-site sewage disposal systems. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 366.032 (b) and (c), Health and Safety Code, to require an authorized agent that adopts an order or resolution with more stringent standards for on-site sewage disposal systems to file the order or resolution with the commission before enactment. Deletes text regarding provides greater public health and safety protection. Deletes text regarding an agent obtaining commission approval. SECTION 2. Effective date: September 1, 2001.
