DIGEST AND PURPOSE 

Currently, the Jefferson County Navigation District does not include Port
Arthur as part of the countywide district. S.B. 1788 sets forth provisions
for the creation of the Jefferson County Waterway and Navigation District.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.

SECTION 1. CREATION. Sets forth provisions regarding the creation of the
Jefferson County Waterway and Navigation District (district). 

SECTION 2. DEFINITIONS. Defines "commissioners court" and "district."

SECTION 3. BOUNDARIES. Sets forth provisions regarding the boundaries of
the district. 

SECTION 4. FINDING OF BENEFIT. Sets forth provisions regarding the benefit
of the district. 

SECTION 5. GENERAL POWERS. Sets forth general powers of the district.

SECTION 6. ADDITIONAL POWERS. Sets forth provisions regarding additional
powers of the district. 

SECTION 7. RELATIONSHIP OF DISTRICT TO EXISTING DISTRICTS IN AREA. Sets
forth provisions regarding the general powers of the district to contract
with other navigation districts. 

SECTION 8. NAVIGATION AND CANAL COMMISSION. Sets forth provisions regarding
the composition of the  district's governing commission. 

SECTION 9. APPOINTMENT OF COMMISSIONERS. Sets forth provisions regarding
the appointment of commissioners. 

SECTION 10. CONFIRMATION ELECTION. Sets forth provisions regarding the
holding of an election. 

SECTION 11. MERGER. Sets forth provisions regarding the merger of the
district. 

SECTION 12. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS. Sets forth
provisions establishing that the procedural requirements necessary for the
district have been met. 

SECTION 13. EFFECTIVE DATE: upon passage or September 1, 2001.
