                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to changing the composition of certain state agency
 1-3     governing bodies with an even number of members to comply with the
 1-4     changes made to Section 30a, Article XVI, Texas Constitution.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           ARTICLE 1.  TEXAS COMMISSION ON ALCOHOL AND DRUG ABUSE
 1-7           SECTION 1.01. Section 461.003(b), Health and Safety Code, is
 1-8     amended to read as follows:
 1-9           (b)  The commission is composed of five [six] members
1-10     appointed by the governor with the advice and consent of the
1-11     senate.
1-12           SECTION 1.02. Section 461.006, Health and Safety Code, is
1-13     amended to read as follows:
1-14           Sec. 461.006.  TERMS. Commission members serve staggered
1-15     six-year terms, with the terms of one or two members expiring
1-16     February 1 of each odd-numbered year.
1-17           SECTION 1.03. (a)  Of the two positions on the Texas
1-18     Commission on Alcohol and Drug Abuse that have terms expiring
1-19     February 1, 2003, one of the positions is abolished, and the
1-20     governor shall appoint a person to fill the other position for a
1-21     term expiring February 1, 2009.
1-22           (b)  The governor shall designate which of the two positions
1-23     is abolished.
1-24           SECTION 1.04. This article takes effect February 1, 2003.
 2-1            ARTICLE 2.  TEXAS COUNCIL ON ALZHEIMER'S DISEASE AND
 2-2                              RELATED DISORDERS
 2-3           SECTION 2.01. Sections 101.002(a) and (b), Health and Safety
 2-4     Code, are amended to read as follows:
 2-5           (a)  The Texas Council on Alzheimer's Disease and Related
 2-6     Disorders is composed of:
 2-7                 (1)  six [five] public members, one of whom is an
 2-8     individual related to a victim of Alzheimer's disease or related
 2-9     disorders but who is not a primary family caregiver, one of whom is
2-10     a primary family caregiver, two of whom are members of an
2-11     Alzheimer's disease and related disorders support group, and two
2-12     [one] of whom are [is an] interested citizens [citizen];
2-13                 (2)  seven professional members with special training
2-14     and interest in Alzheimer's disease and related disorders, with one
2-15     representative each from nursing homes, physicians, nurses, public
2-16     hospitals, private hospitals, home health agencies, and faculty of
2-17     institutions of higher education; and
2-18                 (3)  the chief executive officer or the officer's
2-19     designated representative from the department, Texas Department on
2-20     Aging, Texas Department of Human Services, Texas Department of
2-21     Mental Health and Mental Retardation, and Long-Term Care
2-22     Coordinating Council for the Elderly.
2-23           (b)  The governor shall appoint three [two] public members
2-24     and two professional members, the lieutenant governor shall appoint
2-25     two public members and two professional members, and the speaker of
2-26     the house of representatives shall appoint one public member and
2-27     three professional members.
 3-1           SECTION 2.02. Section 101.004(a), Health and Safety Code, is
 3-2     amended to read as follows:
 3-3           (a)  Appointed council members serve for staggered six-year
 3-4     terms, with the terms of four or five members expiring August 31 of
 3-5     each odd-numbered year.
 3-6           SECTION 2.03. As soon as possible after the effective date of
 3-7     this Act, the governor shall appoint an additional public member to
 3-8     the Texas Council on Alzheimer's Disease and Related Disorders for
 3-9     a term expiring August 31, 2007.
3-10                 ARTICLE 3.  TEXAS ANIMAL HEALTH COMMISSION
3-11           SECTION 3.01. Section 161.021(a), Agriculture Code, is
3-12     amended to read as follows:
3-13           (a)  The commission is composed of thirteen [twelve]
3-14     commissioners appointed by the governor with the advice and consent
3-15     of the senate, with the appropriate number from each of the
3-16     following categories:
3-17                 (1)  a practitioner of veterinary medicine;
3-18                 (2)  a dairyman;
3-19                 (3)  a cattle raiser;
3-20                 (4)  a hog raiser;
3-21                 (5)  a sheep or goat raiser;
3-22                 (6)  a poultry raiser;
3-23                 (7)  an individual involved in the equine industry;
3-24                 (8)  an individual involved in the feedlot industry;
3-25                 (9)  an individual involved in the livestock marketing
3-26     industry;
3-27                 (10)  three [two] members of the general public; and
 4-1                 (11)  an individual involved in the exotic livestock or
 4-2     exotic fowl industry.
 4-3           SECTION 3.02. Section 161.022, Agriculture Code, is amended
 4-4     to read as follows:
 4-5           Sec. 161.022.  TERM. Commissioners serve for staggered terms
 4-6     of six years, with the terms of four or five members expiring every
 4-7     other year.
 4-8           SECTION 3.03. As soon as possible after the effective date of
 4-9     this Act, the governor shall appoint an additional public member to
4-10     the Texas Animal Health Commission for a term expiring September 6,
4-11     2005.
4-12                  ARTICLE 4.  TEXAS COMMISSION ON THE ARTS
4-13           SECTION 4.01. Section 444.003(a), Government Code, is amended
4-14     to read as follows:
4-15           (a)  The commission is composed of 17 [18] members appointed
4-16     by the governor with the advice and consent of the senate.  The
4-17     members must represent all fields of the arts and be widely known
4-18     for their professional competence and experience in connection with
4-19     the arts. At least two members must be residents of a county with a
4-20     population of less than 50,000.  Appointments to the commission
4-21     shall be made without regard to the race, color, disability, sex,
4-22     religion, age, or national origin of the appointees.
4-23           SECTION 4.02. (a)  Of the six positions on the Texas
4-24     Commission on the Arts that have terms expiring August 31, 2003,
4-25     one of the positions is abolished, and the governor shall appoint
4-26     persons to fill the other five positions for terms expiring August
4-27     31, 2009.
 5-1           (b)  The governor shall designate which of the six positions
 5-2     is abolished.
 5-3           SECTION 4.03. This article takes effect August 31, 2003.
 5-4              ARTICLE 5.  AUTOMOBILE THEFT PREVENTION AUTHORITY
 5-5           SECTION 5.01. Sections 3(a), (b), (c), and (e), Article
 5-6     4413(37), Revised Statutes, are amended to read as follows:
 5-7           (a)  The authority is composed of eight [seven] members.
 5-8           (b)  The governor, with the advice and consent of the senate,
 5-9     shall appoint the following seven [six] members:
5-10                 (1)  two representatives of motor vehicle insurance
5-11     consumers;
5-12                 (2)  two representatives of insurance companies writing
5-13     motor vehicle insurance in this state; [and]
5-14                 (3)  two representatives of law enforcement; and
5-15                 (4)  one public member.
5-16           (c)  The director of the Department of Public Safety or the
5-17     director's designee serves ex officio as the eighth [seventh]
5-18     member of the authority.
5-19           (e)  The seven [six] members of the authority appointed by
5-20     the governor serve staggered six-year terms, with the terms of two
5-21     or three members expiring February 1 of each odd-numbered year.  If
5-22     there is a vacancy during a term, the governor shall appoint a
5-23     replacement who meets the requirements of the vacant office to fill
5-24     the unexpired term.
5-25           SECTION 5.02. As soon as possible after the effective date of
5-26     this Act, the governor shall appoint an additional public member to
5-27     the Automobile Theft Prevention Authority for a term expiring
 6-1     February 1, 2007.
 6-2                 ARTICLE 6.  STATE BOARD OF BARBER EXAMINERS
 6-3           SECTION 6.01. Section 1601.051(a), Occupations Code, is
 6-4     amended to read as follows:
 6-5           (a)  The State Board of Barber Examiners consists of seven
 6-6     [six] members appointed by the governor with the advice and consent
 6-7     of the senate as follows:
 6-8                 (1)  two members, each of whom:
 6-9                       (A)  is engaged in the practice of barbering as a
6-10     Class A barber and has been for at least five years before being
6-11     appointed; and
6-12                       (B)  does not hold a barbershop permit;
6-13                 (2)  one member who:
6-14                       (A)  is a barbershop owner who holds a barbershop
6-15     permit; and
6-16                       (B)  is engaged in the practice of barbering and
6-17     has been for at least five years before being appointed;
6-18                 (3)  one member who holds a permit to conduct or
6-19     operate a barber school; and
6-20                 (4)  three [two] members who represent the public.
6-21           SECTION 6.02. Section 1601.055(a), Occupations Code, is
6-22     amended to read as follows:
6-23           (a)  Members of the board serve staggered six-year terms,
6-24     with the terms of two or three members expiring on the same date
6-25     every two years.
6-26           SECTION 6.03. As soon as possible after the effective date of
6-27     this Act, the governor shall appoint an additional public member to
 7-1     the State Board of Barber Examiners for a term expiring January 31,
 7-2     2007.
 7-3          ARTICLE 7.  COUNCIL ON CARDIOVASCULAR DISEASE AND STROKE
 7-4           SECTION 7.01. Section 93.002, Health and Safety Code, as
 7-5     added by Chapter 1411, Acts of the 76th Legislature, Regular
 7-6     Session, 1999, is amended to read as follows:
 7-7           Sec. 93.002.  APPOINTMENT OF COUNCIL; TERMS OF MEMBERS. (a)
 7-8     The Council on Cardiovascular Disease and Stroke is composed of 11
 7-9     [12] members appointed by the board.
7-10           (b)  Members of the council serve staggered six-year terms
7-11     with the terms of approximately one-third of the members expiring
7-12     February 1 of each odd-numbered year.
7-13           SECTION 7.02. (a)  Of the four positions on the Council on
7-14     Cardiovascular Disease and Stroke that have terms expiring February
7-15     1, 2003, one of the positions is abolished, and the Texas Board of
7-16     Health shall appoint persons to fill the other three positions for
7-17     terms expiring February 1, 2009.
7-18           (b)  The board shall designate which of the four positions is
7-19     abolished.
7-20           SECTION 7.03. This article takes effect February 1, 2003.
7-21                  ARTICLE 8.  TEXAS COSMETOLOGY COMMISSION
7-22           SECTION 8.01. Section 1602.051(a), Occupations Code, is
7-23     amended to read as follows:
7-24           (a)  The Texas Cosmetology Commission consists of seven [six]
7-25     members appointed by the governor with the advice and consent of
7-26     the senate as follows:
7-27                 (1)  one member who holds a beauty shop license;
 8-1                 (2)  one member who holds a private beauty culture
 8-2     school license;
 8-3                 (3)  two members who each hold an operator license; and
 8-4                 (4)  three [two] members who represent the public.
 8-5           SECTION 8.02. Section 1602.055(a), Occupations Code, is
 8-6     amended to read as follows:
 8-7           (a)  Members of the commission serve staggered six-year
 8-8     terms, with the terms of two or three members expiring on December
 8-9     31 of each odd-numbered year.
8-10           SECTION 8.03. As soon as possible after the effective date of
8-11     this Act, the governor shall appoint an additional public member to
8-12     the Texas Cosmetology Commission for a term expiring December 31,
8-13     2005.
8-14                 ARTICLE 9.  STATE BOARD OF DENTAL EXAMINERS
8-15           SECTION 9.01. Section 252.001(a), Occupations Code, is
8-16     amended to read as follows:
8-17           (a)  The State Board of Dental Examiners consists of 19 [18]
8-18     members appointed by the governor with the advice and consent of
8-19     the senate as follows:
8-20                 (1)  10 reputable dentist members who reside in this
8-21     state and have been actively engaged in the practice of dentistry
8-22     for at least the five years preceding appointment;
8-23                 (2)  two reputable dental hygienist members who reside
8-24     in this state and have been actively engaged in the practice of
8-25     dental hygiene for at least the five years preceding appointment;
8-26     and
8-27                 (3)  seven [six] members who represent the public.
 9-1           SECTION 9.02. Section 252.004(a), Occupations Code, is
 9-2     amended to read as follows:
 9-3           (a)  Members of the board serve staggered six-year terms.
 9-4     The terms of approximately one-third of the members expire February
 9-5     1 of each odd-numbered year.
 9-6           SECTION 9.03. As soon as possible after the effective date of
 9-7     this Act, the governor shall appoint an additional public member to
 9-8     the State Board of Dental Examiners for a term expiring February 1,
 9-9     2007.
9-10                     ARTICLE 10.  TEXAS DIABETES COUNCIL
9-11           SECTION 10.01. Sections 103.002(a) and (b), Health and Safety
9-12     Code, are amended to read as follows:
9-13           (a)  The Texas Diabetes Council is composed of 13 [12]
9-14     citizen members appointed from the public and one representative
9-15     each from the department, the Texas Education Agency, the Texas
9-16     Department of Human Services, the Texas Commission for the Blind,
9-17     and the Texas Rehabilitation Commission.
9-18           (b)  The governor, with the advice and consent of the senate,
9-19     shall appoint the following citizen members:
9-20                 (1)  a licensed physician with a specialization in
9-21     treating diabetes;
9-22                 (2)  a registered nurse with a specialization in
9-23     diabetes education and training;
9-24                 (3)  a registered and licensed dietitian with a
9-25     specialization in the diabetes education field;
9-26                 (4)  a person with experience and training in public
9-27     health policy;
 10-1                (5)  four consumer members, with special consideration
 10-2    given to persons active in the Texas affiliates of the Juvenile
 10-3    Diabetes Foundation or the American Diabetes Association; and
 10-4                (6)  five [four] members from the general public with
 10-5    expertise or demonstrated commitment to diabetes issues.
 10-6          In making appointments under this section, the governor shall
 10-7    attempt to appoint members of different minority groups including
 10-8    females, African-Americans, Hispanic-Americans, Native Americans,
 10-9    and Asian-Americans.
10-10          SECTION 10.02. Section 103.005(a), Health and Safety Code, is
10-11    amended to read as follows:
10-12          (a)  Council members appointed by the governor serve for
10-13    staggered six-year terms, with the terms of four or five members
10-14    expiring February 1 of each odd-numbered year.
10-15          SECTION 10.03. As soon as possible after the effective date
10-16    of this Act, the governor shall appoint an additional public member
10-17    to the Texas Diabetes Council for a term expiring February 1, 2007.
10-18         ARTICLE 11.  TEXAS DISTINGUISHED SERVICE AWARDS COMMITTEE
10-19          SECTION 11.01. Section 3(b), Chapter 111, Acts of  the  61st
10-20    Legislature, Regular  Session,  1969  (Article  6144h,  Vernon's
10-21    Texas Civil Statutes), is amended to read as follows:
10-22          (b)  The committee shall consist of five [six] members
10-23    appointed for terms of six years.  The terms of one or two members
10-24    expire January 31 of each odd-numbered year [The initial
10-25    appointments to the committee shall be made so that two members
10-26    serve until January 31, 1971, two members serve until January 31,
10-27    1973, and two members serve until January 31, 1975.  Thereafter
 11-1    members shall serve terms of six years].
 11-2          SECTION 11.02. (a)  Of the two positions on the Texas
 11-3    Distinguished Service Awards Committee that have terms expiring
 11-4    January 31, 2003, one of the positions is abolished, and the
 11-5    governor shall appoint a person to fill the other position for a
 11-6    term expiring January 31, 2009.
 11-7          (b)  The governor shall designate which of the two positions
 11-8    is abolished.
 11-9          SECTION 11.03. This article takes effect January 31, 2003.
11-10            ARTICLE 12.  STATE BOARD FOR EDUCATOR CERTIFICATION
11-11          SECTION 12.01. Section 21.033(a), Education Code, is amended
11-12    to read as follows:
11-13          (a)  The State Board for Educator Certification is composed
11-14    of 16 [15] members.  The commissioner of education shall appoint an
11-15    employee of the agency to represent the commissioner as a nonvoting
11-16    member.  The commissioner of higher education shall appoint an
11-17    employee of the Texas Higher Education Coordinating Board to
11-18    represent the commissioner as a nonvoting member.  The governor
11-19    shall appoint a dean of a college of education in this state as a
11-20    nonvoting member.  The remaining 13 [12] members are appointed by
11-21    the governor with the advice and consent of the senate, as follows:
11-22                (1)  four members must be teachers employed in public
11-23    schools;
11-24                (2)  two members must be public school administrators;
11-25                (3)  one member must be a public school counselor; and
11-26                (4)  six [five] members must be citizens, four [three]
11-27    of whom are not and have not, in the five years preceding
 12-1    appointment, been employed by a public school district or by an
 12-2    educator preparation program in an institution of higher education
 12-3    and two of whom are not and have not been employed by a public
 12-4    school district or by an educator preparation program in an
 12-5    institution of higher education.
 12-6          SECTION 12.02. Section 21.034(a), Education Code, is amended
 12-7    to read as follows:
 12-8          (a)  The board members appointed by the governor hold office
 12-9    for staggered terms of six years with the terms of approximately
12-10    one-third of the members expiring on February 1 of each
12-11    odd-numbered year.  A member appointed by the commissioner of
12-12    education or the commissioner of higher education serves at the
12-13    will of the appointing commissioner.
12-14          SECTION 12.03. As soon as possible after the effective date
12-15    of this Act, the governor shall appoint an additional public member
12-16    to the State Board for Educator Certification for a term expiring
12-17    February 1, 2007.
12-18          ARTICLE 13.  TEXAS EMANCIPATION JUNETEENTH CULTURAL AND
12-19                           HISTORICAL COMMISSION
12-20          SECTION 13.01. Section 448.003, Government Code, is amended
12-21    to read as follows:
12-22          Sec. 448.003.  COMPOSITION OF COMMISSION. The commission is
12-23    composed of:
12-24                (1)  five [six] public members appointed by the
12-25    governor with the advice and consent of the senate;
12-26                (2)  two members of the senate appointed by the
12-27    lieutenant governor to serve as ex officio, nonvoting members;
 13-1                (3)  two members of the house of representatives
 13-2    appointed by the speaker of the house to serve as ex officio,
 13-3    nonvoting members; and
 13-4                (4)  the executive director of the Texas Historical
 13-5    Commission to serve as an ex officio, nonvoting member.
 13-6          SECTION 13.02. Section 448.007, Government Code, is amended
 13-7    to read as follows:
 13-8          Sec. 448.007.  TERMS. Public members of the commission serve
 13-9    staggered terms of six years with the terms of approximately
13-10    one-third of the members expiring on February 1 of each
13-11    odd-numbered year.
13-12          SECTION 13.03. (a)  Of the two positions on the Texas
13-13    Emancipation Juneteenth Cultural and Historical Commission that
13-14    have terms expiring February 1, 2003, one of the positions is
13-15    abolished, and the governor shall appoint a person to fill the
13-16    other position for a term expiring February 1, 2009.
13-17          (b)  The governor shall designate which of the two positions
13-18    is abolished.
13-19          SECTION 13.04. This article takes effect February 1, 2003.
13-20             ARTICLE 14.  TEXAS COMMISSION ON FIRE PROTECTION
13-21          SECTION 14.01. Sections 419.004(a) and (b), Government Code,
13-22    are amended to read as follows:
13-23          (a)  The commission is composed of the following 13 [12]
13-24    members:
13-25                (1)  two members to be selected from a list of five
13-26    names submitted by the Texas Fire Chiefs Association who are chief
13-27    officers with a minimum rank that is equivalent to the position
 14-1    immediately below that of the fire chief and who are employed in
 14-2    fire departments as defined by Section 419.021 that are under the
 14-3    jurisdiction of the commission, at least one of whom must be the
 14-4    head of a fire department and one of whom must be employed by a
 14-5    political subdivision with a population of less than 50,000;
 14-6                (2)  two members to be selected from a list of five
 14-7    names submitted by the Texas State Association of Fire Fighters who
 14-8    are fire protection personnel as defined by Section 419.021 with
 14-9    the rank of battalion chief or below and who are employed in fire
14-10    departments or other appropriate local authorities under the
14-11    jurisdiction of the commission, one of whom must be employed by a
14-12    political subdivision with a population of less than 50,000;
14-13                (3)  two members to be selected from a list of five
14-14    names submitted by the State Firemen's and Fire Marshals'
14-15    Association of Texas who are volunteer fire chiefs or volunteer
14-16    fire fighters;
14-17                (4)  one certified fire protection engineer;
14-18                (5)  one certified arson investigator or certified fire
14-19    protection inspector;
14-20                (6)  one fire protection instructor from an institution
14-21    of higher education as defined by Section 61.003, Education Code;
14-22    and
14-23                (7)  four [three] public members.
14-24          (b)  The members of the commission are appointed by the
14-25    governor with the advice and consent of the senate for staggered
14-26    terms of six years with four or five members' terms expiring
14-27    February 1 of each odd-numbered year.
 15-1          SECTION 14.02. As soon as possible after the effective date
 15-2    of this Act, the governor shall appoint an additional public member
 15-3    to the Texas Commission on Fire Protection for a term expiring
 15-4    February 1, 2007.
 15-5                 ARTICLE 15.  GENERAL SERVICES COMMISSION
 15-6          SECTION 15.01. Section 2152.051, Government Code, is amended
 15-7    to read as follows:
 15-8          Sec. 2152.051.  COMPOSITION OF COMMISSION. The commission is
 15-9    composed of five [six] representatives of the public appointed by
15-10    the governor with the advice and consent of the senate.
15-11          SECTION 15.02. Section 2152.057, Government Code, is amended
15-12    to read as follows:
15-13          Sec. 2152.057.  TERMS. Commission members serve staggered
15-14    six-year terms with one or two members' terms expiring January 31
15-15    of each odd-numbered year.
15-16          SECTION 15.03. Section 2152.058(c), Government Code, is
15-17    amended to read as follows:
15-18          (c)  Three [Four] members of the commission constitute a
15-19    quorum.
15-20          SECTION 15.04. (a)  Of the two positions on the General
15-21    Services Commission that have terms expiring January 31, 2003, one
15-22    of the positions is abolished, and the governor shall appoint a
15-23    person to fill the other position for a term expiring January 31,
15-24    2009.
15-25          (b)  The governor shall designate which of the two positions
15-26    is abolished.
15-27          SECTION 15.05. This article takes effect January 31, 2003.
 16-1         ARTICLE 16.  TEXAS HEALTH BENEFITS PURCHASING COOPERATIVE
 16-2          SECTION 16.01. Articles 26.13(b) and (c), Insurance Code, are
 16-3    amended to read as follows:
 16-4          (b)  The Texas cooperative is administered by a seven-member
 16-5    [six-member] board of trustees appointed by the governor with the
 16-6    advice and consent of the senate.  Three members must represent
 16-7    employers, two members must represent employees, and two members
 16-8    [one member] must represent the public.
 16-9          (c)  The appointed members of the board of trustees serve
16-10    staggered six-year terms, with the terms of two or three members
16-11    expiring February 1 of each odd-numbered year.
16-12          SECTION 16.02. As soon as possible after the effective date
16-13    of this Act, the governor shall appoint an additional public member
16-14    to the Texas Health Benefits Purchasing Cooperative for a term
16-15    expiring February 1, 2007.
16-16            ARTICLE 17.  STATEWIDE HEALTH COORDINATING COUNCIL
16-17          SECTION 17.01. Section 104.011(a), Health and Safety Code, is
16-18    amended to read as follows:
16-19          (a)  The statewide health coordinating council is composed of
16-20    18 [17] members determined as follows:
16-21                (1)  the commissioner of health and human services or a
16-22    representative designated by the commissioner;
16-23                (2)  the presiding officer of the Texas Higher
16-24    Education Coordinating Board or a representative designated by the
16-25    presiding officer;
16-26                (3)  the presiding officer of the department or a
16-27    representative designated by the presiding officer;
 17-1                (4)  the presiding officer of the Texas Health Care
 17-2    Information Council or a representative designated by the presiding
 17-3    officer;
 17-4                (5)  the presiding officer of the Texas Department of
 17-5    Mental Health and Mental Retardation or a representative designated
 17-6    by the presiding officer; and
 17-7                (6)  the following members appointed by the governor:
 17-8                      (A)  three health care professionals from the
 17-9    allied health, dental, medical, mental health, nursing, and
17-10    pharmacy professions, no two of whom may be from the same
17-11    profession;
17-12                      (B)  two representatives of a university or
17-13    health-related institution of higher education;
17-14                      (C)  one representative of a junior or community
17-15    college;
17-16                      (D)  one hospital administrator;
17-17                      (E)  one managed care administrator; and
17-18                      (F)  five [four] public members.
17-19          SECTION 17.02. Section 104.0115(a), Health and Safety Code,
17-20    is amended to read as follows:
17-21          (a)  Members of the council who are appointed by the governor
17-22    serve for staggered six-year terms, with the terms of four or five
17-23    members expiring August 31 of each odd-numbered year.
17-24          SECTION 17.03. As soon as possible after the effective date
17-25    of this Act, the governor shall appoint an additional public member
17-26    to the statewide health coordinating council for a term expiring
17-27    August 31, 2007.
 18-1                    ARTICLE 18.  TEXAS BOARD OF HEALTH
 18-2          SECTION 18.01. Sections 11.005(a) and (c), Health and Safety
 18-3    Code, are amended to read as follows:
 18-4          (a)  The board is composed of five [six] members appointed by
 18-5    the governor with the advice and consent of the senate.
 18-6          (c)  Three [Four] members of the board must have a
 18-7    demonstrated interest in the services provided by the department,
 18-8    and two members must represent the public.
 18-9          SECTION 18.02. Section 11.007, Health and Safety Code, is
18-10    amended to read as follows:
18-11          Sec. 11.007.  TERMS. Board members serve for staggered
18-12    six-year terms, with the terms of one or two members expiring
18-13    February 1 of each odd-numbered year.
18-14          SECTION 18.03. Section 11.011(d), Health and Safety Code, is
18-15    amended to read as follows:
18-16          (d)  Three [Four] members of the board constitute a quorum.
18-17          SECTION 18.04. (a)  Of the two positions on the Texas Board
18-18    of Health that have terms expiring February 1, 2003, one of the
18-19    positions is abolished, and the governor shall appoint a person to
18-20    fill the other position for a term expiring February 1, 2009.
18-21          (b)  The governor shall designate which of the two positions
18-22    is abolished.
18-23          SECTION 18.05. This article takes effect February 1, 2003.
18-24                 ARTICLE 19.  TEXAS HISTORICAL COMMISSION
18-25          SECTION 19.01. Sections 442.002(b) and (c), Government Code,
18-26    are amended to read as follows:
18-27          (b)  The commission is composed of 17 [18] members appointed
 19-1    by the governor with the advice and consent of the senate.  One
 19-2    member must be a professional archeologist, one must be a
 19-3    professional historian, and one must be a licensed architect who
 19-4    has expertise in historic preservation and architectural history.
 19-5    Fourteen [Fifteen] members must be representatives of the general
 19-6    public.  A person is not eligible for appointment as a public
 19-7    member of the commission if the person or the person's spouse:
 19-8                (1)  owns or controls, directly or indirectly, more
 19-9    than a 10 percent interest in a business entity or other
19-10    organization regulated by the commission or receiving funds other
19-11    than grant funds from the commission; or
19-12                (2)  uses or receives a substantial amount of tangible
19-13    goods, services, or funds from the commission, other than
19-14    compensation or reimbursement authorized by law for commission
19-15    membership, attendance, or expenses.
19-16          (c)  Members serve for staggered six-year terms, with the
19-17    terms of approximately one-third of the members expiring February 1
19-18    of each odd-numbered year.
19-19          SECTION 19.02. (a)  Of the six positions on the Texas
19-20    Historical Commission that have terms expiring February 1, 2003,
19-21    one of the public member positions is abolished, and the governor
19-22    shall appoint persons to fill the other five positions for terms
19-23    expiring February 1, 2009.
19-24          (b)  The governor shall designate which of the six positions
19-25    is abolished.
19-26          SECTION 19.03. This article takes effect February 1, 2003.
19-27                  ARTICLE 20.  COMMISSION ON HUMAN RIGHTS
 20-1          SECTION 20.01. Section 461.051(a), Government Code, is
 20-2    amended to read as follows:
 20-3          (a)  The commission consists of five [six] members.  One
 20-4    member of the commission shall be a representative of industry, one
 20-5    member shall be a representative of labor, and three [four] members
 20-6    shall be representatives of the public.
 20-7          SECTION 20.02. Of the two positions on the Commission on
 20-8    Human Rights that have terms expiring September 24, 2001, the
 20-9    public member position is abolished, and the governor shall appoint
20-10    a person to fill the other position for a term expiring September
20-11    24, 2007.
20-12          SECTION 20.03. This article takes effect September 24, 2001.
20-13                 ARTICLE 21. TEXAS BOARD OF HUMAN SERVICES
20-14          SECTION 21.01. Sections 21.003(b), (c), and (e), Human
20-15    Resources Code, are amended to read as follows:
20-16          (b)  The board is composed of five [six] members appointed by
20-17    the governor with the advice and consent of the senate and
20-18    representing all geographic regions of the state.  To qualify for
20-19    an appointment to the board, a person must have demonstrated an
20-20    interest in and knowledge of human services.
20-21          (c)  Members of the board serve for staggered terms of six
20-22    years with the term of one or two members expiring on January 20 of
20-23    each odd-numbered year.
20-24          (e)  Three [Four] members of the board constitute a quorum
20-25    for the transaction of business.
20-26          SECTION 21.02. (a)  Of the two positions on the Texas Board
20-27    of Human Services that have terms expiring January 20, 2003, one of
 21-1    the positions is abolished, and the governor shall appoint a person
 21-2    to fill the other position for a term expiring January 20, 2009.
 21-3          (b)  The governor shall designate which of the two positions
 21-4    is abolished.
 21-5          SECTION 21.03. This article takes effect January 20, 2003.
 21-6             ARTICLE 22.  DEPARTMENT OF INFORMATION RESOURCES
 21-7          SECTION 22.01. Sections 2054.021(a) and (b), Government Code,
 21-8    are amended to read as follows:
 21-9          (a)  The department is governed by a board composed of five
21-10    [six] voting members appointed by the governor with the advice and
21-11    consent of the senate.  One member must be employed by an
21-12    institution of higher education as defined by Section 61.003,
21-13    Education Code.
21-14          (b)  Voting members of the board serve for staggered six-year
21-15    terms with one or two members' terms expiring February 1 of each
21-16    odd-numbered year.
21-17          SECTION 22.02. (a)  Of the two positions on the governing
21-18    board of the Department of Information Resources that have terms
21-19    expiring February 1, 2003, one of the positions is abolished, and
21-20    the governor shall appoint a person to fill the other position for
21-21    a term expiring February 1, 2009.
21-22          (b)  The governor shall designate which of the two positions
21-23    is abolished.
21-24          SECTION 22.03. This article takes effect February 1, 2003.
21-25         ARTICLE 23.  TEXAS STATE LIBRARY AND ARCHIVES COMMISSION
21-26          SECTION 23.01. Section 441.001(a), Government Code, is
21-27    amended to read as follows:
 22-1          (a)  The Texas State Library and Archives Commission is
 22-2    composed of five [six] members appointed by the governor with the
 22-3    advice and consent of the senate.  All five [six] members must be
 22-4    representatives of the general public.  A person is not eligible
 22-5    for appointment as a member of the commission if the person or the
 22-6    person's spouse:
 22-7                (1)  is registered, certified, or licensed by an
 22-8    occupational regulatory agency in the field of library or
 22-9    information science;
22-10                (2)  is employed by or participates in the management
22-11    of a business entity or other organization regulated by the
22-12    commission or receiving funds from the commission;
22-13                (3)  owns or controls, directly or indirectly, more
22-14    than a 10 percent interest in a business entity or other
22-15    organization regulated by the commission or receiving funds from
22-16    the commission; or
22-17                (4)  uses or receives a substantial amount of tangible
22-18    goods, services, or funds from the commission, other than
22-19    compensation or reimbursement authorized by law for commission
22-20    membership, attendance, or expenses.
22-21          SECTION 23.02. (a)  Of the two positions on the Texas State
22-22    Library and Archives Commission that have terms expiring September
22-23    28, 2001, one of the positions is abolished, and the governor shall
22-24    appoint a person to fill the other position for a term expiring
22-25    September 28, 2007.
22-26          (b)  The governor shall designate which of the two positions
22-27    is abolished.
 23-1          SECTION 23.03. This article takes effect September 28, 2001.
 23-2         ARTICLE 24.  TEXAS COMMISSION OF LICENSING AND REGULATION
 23-3          SECTION 24.01. Section 51.052(a), Occupations Code, is
 23-4    amended to read as follows:
 23-5          (a)  The commission consists of five [six] members appointed
 23-6    by the governor with the advice and consent of the senate.
 23-7          SECTION 24.02. Section 51.055(a), Occupations Code, is
 23-8    amended to read as follows:
 23-9          (a)  Members of the commission serve staggered six-year
23-10    terms.  The terms of one or two members expire on February 1 of
23-11    each odd-numbered year.
23-12          SECTION 24.03. (a)  Of the two positions on the Texas
23-13    Commission of Licensing and Regulation that have terms expiring
23-14    February 1, 2003, one of the positions is abolished, and the
23-15    governor shall appoint a person to fill the other position for a
23-16    term expiring February 1, 2009.
23-17          (b)  The governor shall designate which of the two positions
23-18    is abolished.
23-19          SECTION 24.04. This article takes effect February 1, 2003.
23-20            ARTICLE 25.  TEXAS STATE BOARD OF MEDICAL EXAMINERS
23-21          SECTION 25.01. Section 152.002(a), Occupations Code, is
23-22    amended to read as follows:
23-23          (a)  The board consists of 19 [18] members appointed by the
23-24    governor with the advice and consent of the senate as follows:
23-25                (1)  twelve members who are learned and eminent
23-26    physicians licensed in this state for at least three years before
23-27    the appointment, nine of whom must be graduates of a reputable
 24-1    medical school or college with a degree of doctor of medicine
 24-2    (M.D.) and three of whom must be graduates of a reputable medical
 24-3    school or college with a degree of doctor of osteopathic medicine
 24-4    (D.O.); and
 24-5                (2)  seven [six] members who represent the public.
 24-6          SECTION 25.02. As soon as possible after the effective date
 24-7    of this Act, the governor shall appoint an additional public member
 24-8    to the Texas State Board of Medical Examiners for a term expiring
 24-9    April 13, 2007.
24-10             ARTICLE 26.  TEXAS MILITARY FACILITIES COMMISSION
24-11          SECTION 26.01. Section 435.004(a), Government Code, is
24-12    amended to read as follows:
24-13          (a)  The commission is composed of:
24-14                (1)  one senior officer of the Texas National Guard who
24-15    is appointed by the governor with the advice and consent of the
24-16    senate from a list submitted by the adjutant general and who must
24-17    be actively serving in the Texas National Guard at the time of
24-18    appointment; and
24-19                (2)  six [five] members of the general public who are
24-20    appointed by the governor with the advice and consent of the
24-21    senate, who must not be actively serving in the Texas National
24-22    Guard while serving as members of the commission, and two of whom
24-23    must have experience in architecture, civil engineering, or
24-24    construction management.
24-25          SECTION 26.02. As soon as possible after the effective date
24-26    of this Act, the governor shall appoint an additional member to the
24-27    Texas Military Facilities Commission for a term expiring April 30,
 25-1    2007.
 25-2       ARTICLE 27.  MULTI-STATE WATER RESOURCES PLANNING COMMISSION
 25-3          SECTION 27.01. Sections 8.013(a) and (c), Water Code, are
 25-4    amended to read as follows:
 25-5          (a)  The commission is composed of seven [six] commissioners
 25-6    who are appointed by the governor with the advice and consent of
 25-7    the senate.
 25-8          (c)  Three [Two] commissioners must be members of the general
 25-9    public, one commissioner must have a background in the field of
25-10    higher education, one commissioner must have a background in
25-11    private business, one commissioner must have a background in
25-12    agriculture, and one commissioner must have a background in an
25-13    energy-related field.
25-14          SECTION 27.02. Section 8.015(a), Water Code, is amended to
25-15    read as follows:
25-16          (a)  Commissioners hold office for staggered terms of six
25-17    years, with the terms of two or three commissioners expiring on
25-18    February 1 of each odd-numbered year.
25-19          SECTION 27.03. As soon as possible after the effective date
25-20    of this Act, the governor shall appoint an additional public member
25-21    to the Multi-State Water Resources Planning Commission for a term
25-22    expiring February 1, 2007.
25-23           ARTICLE 28.  TEXAS BOARD OF ORTHOTICS AND PROSTHETICS
25-24          SECTION 28.01. Section 605.052(a), Occupations Code, is
25-25    amended to read as follows:
25-26          (a)  The board consists of seven [six] members appointed by
25-27    the governor with the advice and consent of the senate as follows:
 26-1                (1)  one licensed orthotist member who has practiced
 26-2    orthotics for the five years preceding the date of appointment;
 26-3                (2)  one licensed prosthetist member who has practiced
 26-4    prosthetics for the five years preceding the date of appointment;
 26-5                (3)  one licensed prosthetist orthotist member who has
 26-6    practiced orthotics and prosthetics for the five years preceding
 26-7    the date of appointment;
 26-8                (4)  one member who is a representative of the public
 26-9    who uses an orthosis;
26-10                (5)  one member who is a representative of the public
26-11    who uses a prosthesis; and
26-12                (6)  two members [one member] who are representatives
26-13    [is a representative] of the public who do [does] not use an
26-14    orthosis or prosthesis.
26-15          SECTION 28.02. Section 605.055(a), Occupations Code, is
26-16    amended to read as follows:
26-17          (a)  Members of the board serve staggered six-year terms.
26-18    The terms of two or three members expire on February 1 of each
26-19    odd-numbered year.
26-20          SECTION 28.03. As soon as possible after the effective date
26-21    of this Act, the governor shall appoint an additional public member
26-22    to the Texas Board of Orthotics and Prosthetics for a term expiring
26-23    February 1, 2007.
26-24                  ARTICLE 29.  POLYGRAPH EXAMINERS BOARD
26-25          SECTION 29.01. Section 1703.051(a), Occupations Code, is
26-26    amended to read as follows:
26-27          (a)  The Polygraph Examiners Board consists of seven [six]
 27-1    members appointed by the governor with the advice and consent of
 27-2    the senate as follows:
 27-3                (1)  two polygraph examiner members who are qualified
 27-4    polygraph examiners for a governmental law enforcement agency, one
 27-5    of whom must be the supervisor of the department's polygraph
 27-6    section;
 27-7                (2)  two polygraph examiner members who are qualified
 27-8    polygraph examiners in the commercial field; and
 27-9                (3)  three [two] members who represent the public.
27-10          SECTION 29.02. As soon as possible after the effective date
27-11    of this Act, the governor shall appoint an additional public member
27-12    to the Polygraph Examiners Board for a term expiring June 18, 2007.
27-13                 ARTICLE 30.  PRODUCE RECOVERY FUND BOARD
27-14          SECTION 30.01. Section 103.003(a), Agriculture Code, is
27-15    amended to read as follows:
27-16          (a)  The Produce Recovery Fund Board is composed of seven
27-17    [six] members appointed by the governor with the advice and consent
27-18    of the senate.  Two members must be producers, two must be license
27-19    holders licensed under Chapter 101, and three [two] must be members
27-20    of the general public.
27-21          SECTION 30.02. As soon as possible after the effective date
27-22    of this Act, the governor shall appoint an additional public member
27-23    to the Produce Recovery Fund Board for a term expiring January 31,
27-24    2007.
27-25         ARTICLE 31.  BOARD OF PROTECTIVE AND REGULATORY SERVICES
27-26          SECTION 31.01. Sections 40.021(a) and (b), Human Resources
27-27    Code, are amended to read as follows:
 28-1          (a)  The board is composed of seven [six] members appointed
 28-2    by the governor with the advice and consent of the senate.  The
 28-3    governor shall designate one member to be the presiding officer of
 28-4    the board to serve in that capacity at the pleasure of the
 28-5    governor.
 28-6          (b)  Four members of the board must have a demonstrated
 28-7    interest in the services provided by the department, and three
 28-8    [two] members must represent the public.
 28-9          SECTION 31.02. Section 40.024, Human Resources Code, is
28-10    amended to read as follows:
28-11          Sec. 40.024.  BOARD TERMS. Members of the board serve
28-12    six-year terms, with the terms of two or three members expiring
28-13    February 1 of each odd-numbered year.
28-14          SECTION 31.03. As soon as possible after the effective date
28-15    of this Act, the governor shall appoint an additional public member
28-16    to the Board of Protective and Regulatory Services for a term
28-17    expiring February 1, 2007.
28-18                ARTICLE 32.  TEXAS PUBLIC FINANCE AUTHORITY
28-19          SECTION 32.01. Section 1232.052(a), Government Code, is
28-20    amended to read as follows:
28-21          (a)  The authority is governed by a board of directors
28-22    composed of five [six] members appointed by the governor with the
28-23    advice and consent of the senate.
28-24          SECTION 32.02. Section 1232.053, Government Code, is amended
28-25    to read as follows:
28-26          Sec. 1232.053.  TERMS. Members of the board are appointed for
28-27    staggered terms of six years, with one or two members' terms
 29-1    expiring February 1 of each odd-numbered year.
 29-2          SECTION 32.03. (a)  Of the two positions on the Texas Public
 29-3    Finance Authority that have terms expiring February 1, 2003, one of
 29-4    the positions is abolished, and the governor shall appoint a person
 29-5    to fill the other position for a term expiring February 1, 2009.
 29-6          (b)  The governor shall designate which of the two positions
 29-7    is abolished.
 29-8          SECTION 32.04. This article takes effect February 1, 2003.
 29-9                   ARTICLE 33.  TEXAS RACING COMMISSION
29-10          SECTION 33.01. Section 2.02(a), Texas Racing Act (Article
29-11    179e, Vernon's Texas Civil Statutes), is amended to read as
29-12    follows:
29-13          (a)  The commission consists of seven [six] members appointed
29-14    by the governor with the advice and consent of the senate and two
29-15    ex officio members who shall have the right to vote.  The ex
29-16    officio members are:
29-17                (1)  the chairman of the Public Safety Commission or a
29-18    member of the Public Safety Commission designated by the chairman
29-19    of the Public Safety Commission; and
29-20                (2)  the comptroller of public accounts or the
29-21    comptroller's designee.
29-22          SECTION 33.02. Section 2.03(a), Texas Racing Act (Article
29-23    179e, Vernon's Texas Civil Statutes), is amended to read as
29-24    follows:
29-25          (a)  Appointed members hold office for staggered terms of six
29-26    years with two or three members' terms expiring February 1 of each
29-27    odd-numbered year.  A member holds office until that member's
 30-1    successor is appointed and qualifies.
 30-2          SECTION 33.03. Section 2.05(a), Texas Racing Act (Article
 30-3    179e, Vernon's Texas Civil Statutes), is amended to read as
 30-4    follows:
 30-5          (a)  Five [Four] of the appointed members of the commission
 30-6    must be representatives of the general public and have general
 30-7    knowledge of business or agribusiness.  One additional appointed
 30-8    member must have special knowledge or experience related to
 30-9    greyhound racing and one additional appointed member must have
30-10    special knowledge or experience related to horse racing.  A person
30-11    is not eligible for appointment as a member of the commission if
30-12    the person or the person's spouse:
30-13                (1)  is licensed by the commission, except as a
30-14    commissioner;
30-15                (2)  is employed by the commission or participates in
30-16    the management of a business entity or other organization regulated
30-17    by the commission or receiving funds from or through the
30-18    commission;
30-19                (3)  owns or controls, directly or indirectly, more
30-20    than a 10 percent interest in a business entity or other
30-21    organization regulated by the commission or receiving funds from or
30-22    through the commission; or
30-23                (4)  uses or receives a substantial amount of tangible
30-24    goods, services, or funds from or through the commission, other
30-25    than compensation or reimbursement authorized by law for commission
30-26    membership, attendance, or expenses.
30-27          SECTION 33.04.  As soon as possible after the effective date
 31-1    of this Act, the governor shall appoint an additional public member
 31-2    to the Texas Racing Commission for a term expiring February 1,
 31-3    2007.
 31-4               ARTICLE 34.  TEXAS REHABILITATION COMMISSION
 31-5          SECTION 34.01. Section 111.013(a), Human Resources Code, is
 31-6    amended to read as follows:
 31-7          (a)  The board of the Texas Rehabilitation Commission is
 31-8    composed of five [six] members appointed by the governor with the
 31-9    advice and consent of the senate.  Members serve for staggered
31-10    terms of six years with the terms of one or two members expiring
31-11    every two years.
31-12          SECTION 34.02. (a)  Of the two positions on the Texas
31-13    Rehabilitation Commission that have terms expiring August 31, 2001,
31-14    one of the positions is abolished, and the governor shall appoint a
31-15    person to fill the other position for a term expiring August 31,
31-16    2007.
31-17          (b)  The governor shall designate which of the two positions
31-18    is abolished.
31-19          SECTION 34.03. This article takes effect August 31, 2001.
31-20                    ARTICLE 35.  RISK MANAGEMENT BOARD
31-21          SECTION 35.01. Sections 412.021(a), (b), and (c), Labor Code,
31-22    are amended to read as follows:
31-23          (a)  The office is governed by the risk management board.
31-24    Members of the board, except for one public member, must have
31-25    demonstrated experience in the field of workers' compensation and
31-26    risk management administration.
31-27          (b)  The board is composed of seven [six] members appointed
 32-1    by the governor.
 32-2          (c)  Members of the board hold office for staggered terms of
 32-3    six years with two or three members' terms expiring February 1 of
 32-4    each odd-numbered year.  A member appointed to fill a vacancy shall
 32-5    hold office for the remainder of that term.
 32-6          SECTION 35.02. As soon as possible after the effective date
 32-7    of this Act, the governor shall appoint a public member to the risk
 32-8    management board for a term expiring February 1, 2007.
 32-9              ARTICLE 36.  COUNCIL ON SEX OFFENDER TREATMENT
32-10          SECTION 36.01. Section 3(a), Chapter 462, Acts of the 68th
32-11    Legislature, Regular  Session, 1983 (Article 4413(51), Vernon's
32-12    Texas Civil Statutes), is amended to read as follows:
32-13          (a)  The council is composed of seven [six] part-time
32-14    members, including three [two] members who are representatives of
32-15    the general public and four members each of whom meets the
32-16    council's requirements for registration as a sex offender treatment
32-17    provider.  A person is not eligible for appointment as a public
32-18    member if the person meets the council's requirements for
32-19    registration as a sex offender treatment provider or if the person
32-20    or the person's spouse:
32-21                (1)  is registered, certified, or licensed by an
32-22    occupational regulatory agency in the field of sex offender
32-23    treatment;
32-24                (2)  is employed by or participates in the management
32-25    of a business entity or other organization regulated by the council
32-26    or receiving funds from the council;
32-27                (3)  owns or controls, directly or indirectly, more
 33-1    than a 10 percent interest in a business entity or other
 33-2    organization regulated by the council or receiving funds from the
 33-3    council; or
 33-4                (4)  uses or receives a substantial amount of tangible
 33-5    goods, services, or funds from the council, other than compensation
 33-6    or reimbursement authorized by law for council membership,
 33-7    attendance, or expenses.
 33-8          SECTION 36.02. Section 4(a), Chapter 462, Acts of the 68th
 33-9    Legislature, Regular  Session, 1983 (Article 4413(51), Vernon's
33-10    Texas Civil Statutes), is amended to read as follows:
33-11          (a)  Members of the council hold office for staggered terms
33-12    of six years, with two or three members' terms expiring February 1
33-13    of each odd-numbered year.
33-14          SECTION 36.03. As soon as possible after the effective date
33-15    of this Act, the governor shall appoint an additional public member
33-16    to the Council on Sex Offender Treatment for a term expiring
33-17    February 1, 2007.
33-18             ARTICLE 37.  TEXAS STRUCTURAL PEST CONTROL BOARD
33-19          SECTION 37.01. Section 3(a), Texas Structural Pest Control
33-20    Act (Article 135b-6, Vernon's Texas Civil Statutes), is amended to
33-21    read as follows:
33-22          (a)  The Texas Structural Pest Control Board is composed of
33-23    10 [nine] members, seven [six] of whom shall be appointed.  Three
33-24    of the appointed members must be persons who have been engaged in
33-25    the business of structural pest control for at least five years
33-26    immediately preceding the appointment, none of whom may be
33-27    representatives of the same business entity.  Four [Three] members
 34-1    must be representatives of the general public who are not licensed
 34-2    under this Act. These appointments to the board shall be made by
 34-3    the Governor with the advice and consent of the Senate.  Appointed
 34-4    members of the board hold office for staggered terms of six years,
 34-5    with the terms of one business and one or two public members
 34-6    [member] expiring February 1 of each odd-numbered year.
 34-7    Appointments to the board shall be made without regard to the race,
 34-8    color, handicap, sex, religion, age, or national origin of the
 34-9    appointees.  In addition to the appointed members, the board shall
34-10    also consist of the Commissioner of Agriculture, the Commissioner
34-11    of Health, and the chairman of the Department of Entomology at
34-12    Texas A&M University, or their designated representatives.
34-13          SECTION 37.02. As soon as possible after the effective date
34-14    of this Act, the governor shall appoint an additional public member
34-15    to the Texas Structural Pest Control Board for a term expiring
34-16    February 1, 2007.
34-17             ARTICLE 38.  BOARD OF TAX PROFESSIONAL EXAMINERS
34-18          SECTION 38.01.  Sections 4(b), (c), and (d), The Property
34-19    Taxation Professional Certification Act (Article 8885, Revised
34-20    Statutes), are amended to read as follows:
34-21          (b)  The board consists of seven [six] members appointed by
34-22    the governor with the advice and consent of the senate.  One of the
34-23    members must represent the general public.  A vacancy on the board
34-24    is filled in the same manner for the unexpired portion of the term.
34-25          (c)  Except for the public member, to [To] be eligible to
34-26    serve on the board an individual must:
34-27                (1)  be a resident of this state;
 35-1                (2)  be actively engaged in property tax
 35-2    administration;
 35-3                (3)  have at least five years experience in appraisal,
 35-4    assessment, or collections for property tax purposes; and
 35-5                (4)  be certified as a registered professional
 35-6    appraiser, registered Texas collector, or registered Texas assessor
 35-7    under this Act.
 35-8          (d)  Members hold office for terms of six years, with the
 35-9    terms of two or three members expiring on March 1 of each
35-10    odd-numbered year.
35-11          SECTION 38.02. As soon as possible after the effective date
35-12    of this Act, the governor shall appoint a public member to the
35-13    Board of Tax Professional Examiners for a term expiring March 1,
35-14    2007.
35-15               ARTICLE 39.  COMMISSION ON UNIFORM STATE LAWS
35-16          SECTION 39.01.  Sections 762.003(a) and (c), Government Code,
35-17    are amended to read as follows:
35-18          (a)  The commission is composed of:
35-19                (1)  five [six] members appointed by the governor; and
35-20                (2)  residents of this state who, because of long
35-21    service in the cause of uniformity in state legislation, have been
35-22    elected life members of the national conference or who have at
35-23    least 15 years of service as a member of the commission and at
35-24    least five years of combined service as a judge or justice of a
35-25    trial or appellate court of this state.
35-26          (c)  Appointed members serve staggered six-year terms, with
35-27    the terms of one or two members expiring September 30 of each
 36-1    even-numbered year.
 36-2          SECTION 39.02. (a)  Of the two positions on the Commission on
 36-3    Uniform State Laws that have terms expiring September 30, 2002, one
 36-4    of the positions is abolished, and the governor shall appoint a
 36-5    person to fill the other position for a term expiring September 30,
 36-6    2008.
 36-7          (b)  The governor shall designate which of the two positions
 36-8    is abolished.
 36-9          SECTION 39.03. This article takes effect September 30, 2002.
36-10                  ARTICLE 40.  TEXAS VETERANS COMMISSION
36-11          SECTION 40.01.  Sections 434.003(a) and (b), Government Code,
36-12    are amended to read as follows:
36-13          (a)  The commission is composed of seven [six] members
36-14    appointed by the governor with the advice and consent of the
36-15    senate.  The governor shall make each appointment without regard to
36-16    the race, creed, sex, religion, or national origin of the
36-17    appointee.
36-18          (b)  A member must be a citizen and resident of the state.
36-19    At least four members must have been honorably discharged or
36-20    honorably released from active military service of the United
36-21    States.  At least one member must be a person classified as a
36-22    disabled veteran by the United States Veterans Administration or
36-23    the branch of the United States armed forces in which the person
36-24    served.  This person's disability must be service-connected and
36-25    compensable.  At least one member must be a public member.
36-26          SECTION 40.02. As soon as possible after the effective date
36-27    of this Act, the governor shall appoint a public member to the
 37-1    Texas Veterans Commission for a term expiring December 31, 2005.
 37-2            ARTICLE 41.  TEXAS WORKERS' COMPENSATION COMMISSION
 37-3          SECTION 41.01.  Sections 402.001(a) and (c), Labor Code, are
 37-4    amended to read as follows:
 37-5          (a)  The Texas Workers' Compensation Commission is composed
 37-6    of seven [six] members appointed by the governor with the advice
 37-7    and consent of the senate.
 37-8          (c)  Three members of the commission must be employers of
 37-9    labor, [and] three members of the commission must be wage earners,
37-10    and one member must represent the general public.  A person is not
37-11    eligible for appointment as a member of the commission if the
37-12    person provides services subject to regulation by the commission or
37-13    charges fees that are subject to regulation by the commission.
37-14          SECTION 41.02. As soon as possible after the effective date
37-15    of this Act, the governor shall appoint a public member to the
37-16    Texas Workers' Compensation Commission for a term expiring February
37-17    1, 2007.
37-18                    ARTICLE 42.  TEXAS YOUTH COMMISSION
37-19          SECTION 42.01.  Sections 61.012(a) and (c), Human Resources
37-20    Code, are amended to read as follows:
37-21          (a)  The governing board of the Texas Youth Commission
37-22    consists of five [six] members appointed by the governor with the
37-23    consent of the senate.  Appointments to the board shall be made
37-24    without regard to the race, color, disability, sex, religion, age,
37-25    or national origin of the appointees.
37-26          (c)  The board members hold office for staggered terms of six
37-27    years, with the terms of one or two members expiring every two
 38-1    years.
 38-2          SECTION 42.02.  Section 61.014, Human Resources Code, is
 38-3    amended to read as follows:
 38-4          Sec. 61.014.  QUORUM.  Three [Four] members constitute a
 38-5    quorum for the exercise of functions of the commission not
 38-6    delegated to the executive director or other employees.
 38-7          SECTION 42.03. (a)  Of the two positions on the Texas Youth
 38-8    Commission that have terms expiring August 31, 2001, one of the
 38-9    positions is abolished, and the governor shall appoint a person to
38-10    fill the other position for a term expiring August 31, 2007.
38-11          (b)  The governor shall designate which of the two positions
38-12    is abolished.
38-13          SECTION 42.04. This article takes effect August 31, 2001.
38-14                 ARTICLE 43.  CONSTRUCTION; EFFECTIVE DATE
38-15          SECTION 43.01. In the event of a conflict between a provision
38-16    of this Act and another Act passed by the 77th Legislature, Regular
38-17    Session, 2001, that becomes law, the other law controls.
38-18          SECTION 43.02. Except as otherwise provided by this Act, this
38-19    Act takes effect September 1, 2001.
