 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the punishment for the offense of burglary of a
 1-9     vehicle.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 16(b), Article 42.12, Code of Criminal
1-12     Procedure, is amended to read as follows:
1-13           (b)  The amount of community service work ordered by the
1-14     judge:
1-15                 (1)  may not exceed 1,000 hours and may not be less
1-16     than 320 hours for an offense classified as a first degree felony;
1-17                 (2)  may not exceed 800 hours and may not be less than
1-18     240 hours for an offense classified as a second degree felony;
1-19                 (3)  may not exceed 600 hours and may not be less than
1-20     160 hours for an offense classified as a third degree felony;
1-21                 (4)  may not exceed 400 hours and may not be less than
1-22     120 hours for an offense classified as a state jail felony;
1-23                 (5)  may not:
1-24                       (A)  exceed 600 hours or be less than 160 hours
1-25     for an offense under Section 30.04, Penal Code, classified as a
1-26     Class A misdemeanor; or
1-27                       (B)  exceed 200 hours or [and may not] be less
1-28     than 80 hours for any other [an] offense classified as a Class A
1-29     misdemeanor or for any other misdemeanor for which the maximum
1-30     permissible confinement, if any, exceeds six months or the maximum
1-31     permissible fine, if any, exceeds $4,000; and
1-32                 (6)  may not exceed 100 hours and may not be less than
1-33     24 hours for an offense classified as a Class B misdemeanor or for
1-34     any other misdemeanor for which the maximum permissible
1-35     confinement, if any, does not exceed six months and the maximum
1-36     permissible fine, if any, does not exceed $4,000.
1-37           SECTION 2. (a)  The change in law made by this Act applies
1-38     only to an offense committed on or after the effective date of this
1-39     Act.  For purposes of this section, an offense is committed before
1-40     the effective date of this Act if any element of the offense occurs
1-41     before the effective date.
1-42           (b)  An offense committed before the effective date of this
1-43     Act is covered by the law in effect when the offense was committed,
1-44     and the former law is continued in effect for that purpose.
1-45           SECTION 3.  This Act takes effect September 1, 2001.
