 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the creation of an offense prohibiting the covert
 1-9     photography or visual recording of another for an improper sexual
1-10     purpose.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Chapter 21, Penal Code, is amended by adding
1-13     Section 21.15 to read as follows:
1-14           Sec. 21.15.  IMPROPER PHOTOGRAPHY OR VISUAL RECORDING.  (a)
1-15     A person commits an offense if the person photographs or by
1-16     videotape or other electronic means visually records another:
1-17                 (1)  without the other person's consent; and
1-18                 (2)  with intent to arouse or gratify the sexual desire
1-19     of any person.
1-20           (b)  An offense under this section is a state jail felony.
1-21           SECTION 2.  This Act takes effect September 1, 2001.
