A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to public school campus report cards.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 39.052(b), Education Code, as amended by
1-5 Chapters 396 and 1514, Acts of the 76th Legislature, Regular
1-6 Session, 1999, is reenacted and amended to read as follows:
1-7 (b) The report card shall include the following information
1-8 where applicable:
1-9 (1) the academic excellence indicators adopted under
1-10 Sections 39.051(b)(1) through (9);
1-11 (2) average class size by grade level and subject;
1-12 [and]
1-13 (3) administrative and instructional costs per
1-14 student;
1-15 (4) the percentage of students whose parent had
1-16 personal contact with the student's teacher during the school year
1-17 concerning the student's education;
1-18 (5) the percentage of students whose parent responded
1-19 to written or oral communication from school personnel for which a
1-20 response was requested;
1-21 (6) the percentage of students transferring to the
1-22 campus and the percentage of students transferring from the campus,
1-23 determined in the manner prescribed by rule adopted by the
1-24 commissioner;
2-1 (7) the percentage of students having unexcused
2-2 voluntary absences for the amount of time specified under Section
2-3 51.03(b)(2), Family Code; and
2-4 (8) the percentage of students graduating and the
2-5 percentage of graduating students accepted by a junior college or
2-6 senior college or university, determined in the manner prescribed
2-7 by rule adopted by the commissioner.
2-8 SECTION 2. Section 39.052, Education Code, is amended by
2-9 amending Subsection (c) and adding Subsection (d) to read as
2-10 follows:
2-11 (c) The commissioner shall adopt rules for requiring
2-12 dissemination of appropriate class size and student performance
2-13 portions of campus report cards and of the information prescribed
2-14 by Subsections (b)(4)-(7) and Sections 39.051(b)(2) and (3)
2-15 annually to the parent[, guardian, conservator, or other person
2-16 having lawful control] of each student at the campus. On written
2-17 request, the school district shall provide a copy of a campus
2-18 report card to any other party.
2-19 (d) In this section:
2-20 (1) "Parent" includes the guardian, conservator, or
2-21 other person having lawful control of a student.
2-22 (2) "Personal contact" includes contact:
2-23 (A) at a parent-teacher conference;
2-24 (B) through a visit to the school by the
2-25 student's parent;
2-26 (C) through a visit to the student's home by the
2-27 student's teacher;
3-1 (D) by telephone; and
3-2 (E) through written correspondence.
3-3 SECTION 3. This Act takes effect immediately and applies to
3-4 public school campus report cards beginning with campus report
3-5 cards for the 2001-2002 school year.
