1-1                                   AN ACT
 1-2     relating to the regulation of certain health care activities using
 1-3     the Internet.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subtitle A, Title 3, Occupations Code, is amended
 1-6     by adding Chapter 105 to read as follows:
 1-7            CHAPTER 105.  GENERAL REGULATORY AUTHORITY REGARDING
 1-8                 HEALTH CARE PRACTITIONERS' USE OF INTERNET
 1-9           Sec. 105.001.  EFFECT OF INTERNET ACTIVITY.   (a)  In this
1-10     section:
1-11                 (1)  "Licensing authority" means a department,
1-12     commission, board, office, or other agency of the state or a
1-13     political subdivision of the state that regulates activities and
1-14     persons under this title.
1-15                 (2)  "Internet" has the meaning assigned by Section
1-16     2002.001, Government Code.
1-17           (b)  The fact that an activity occurs through the use of the
1-18     Internet does not affect a licensing authority's power to regulate
1-19     an activity or person that would otherwise be regulated under this
1-20     title.
1-21           SECTION 2.  This Act takes effect immediately if it receives
1-22     a vote of two-thirds of all the members elected to each house, as
1-23     provided by Section 39, Article III, Texas Constitution.  If this
1-24     Act does not receive the vote necessary for immediate effect, this
 2-1     Act takes effect September 1, 2001.
