No. 101 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to medical assistance for certain persons in need of 1-3 treatment for breast or cervical cancer. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 32.024, Human Resources Code, is amended 1-6 by adding Subsection (x) to read as follows: 1-7 (x) The department shall provide medical assistance to a 1-8 person in need of treatment for breast or cervical cancer who is 1-9 eligible for that assistance under the Breast and Cervical Cancer 1-10 Prevention and Treatment Act of 2000 (Pub. L. No. 106-354) for a 1-11 continuous period during which the person requires that treatment. 1-12 The department shall simplify the provider enrollment process for a 1-13 provider of that medical assistance and shall adopt rules to 1-14 provide for certification of presumptive eligibility of a person 1-15 for that assistance. In determining a person's eligibility for 1-16 medical assistance under this subsection, the department, to the 1-17 extent allowed by federal law, may not require a personal 1-18 interview. 1-19 SECTION 2. If before implementing any provision of this Act 1-20 a state agency determines that a waiver or authorization from a 1-21 federal agency is necessary for implementation of that provision, 1-22 the agency affected by the provision shall request the waiver or 1-23 authorization and may delay implementing that provision until the 1-24 waiver or authorization is granted. 2-1 SECTION 3. This Act takes effect September 1, 2001.
