                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to tattooing minors.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 146.012(a), Health and Safety Code, is
 1-5     amended to read as follows:
 1-6           (a)  A tattooist may not tattoo:
 1-7                 (1)  a person younger than 18 years of age without
 1-8     consent from the person's [individual's] parent or guardian [who
 1-9     determines it to be in the best interest to cover a tattoo which
1-10     contains:]
1-11                       [(A)  obscene or offensive language or symbols;]
1-12                       [(B)  gang-related names, symbols, or markings;]
1-13                       [(C)  drug-related names, symbols, or pictures;
1-14     or]
1-15                       [(D)  some other type of words, symbols, or
1-16     markings that the court considers would be in the best interest of
1-17     the minor to cover]; or
1-18                 (2)  a person whom the tattooist suspects is under the
1-19     influence of alcohol or drugs.
1-20           SECTION 2. Section 146.012(c), Health and Safety Code, is
1-21     repealed.
1-22           SECTION 3.  This Act takes effect September 1, 2001.
