                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to registration with the Selective Service System of
 1-3     certain applicants for a driver's license.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 521.044(a), Transportation Code, is
 1-6     amended to read as follows:
 1-7           (a)  Information provided on a driver's license application
 1-8     that relates to the applicant's social security number may be used
 1-9     only by the department or disclosed only to:
1-10                 (1)  the child support enforcement division of the
1-11     attorney general's office;  [or]
1-12                 (2)  another state entity responsible for enforcing the
1-13     payment of child support; or
1-14                 (3)  the United States Selective Service System as
1-15     provided by Section 521.147.
1-16           SECTION 2.  Subchapter G, Chapter 521, Transportation Code,
1-17     is amended by adding Section 521.147 to read as follows:
1-18           Sec. 521.147.  REGISTRATION WITH SELECTIVE SERVICE SYSTEM.
1-19     (a)  After an application for an original, renewal, or duplicate
1-20     driver's license is submitted by a male applicant who on the date
1-21     of the application is at least 18 years of age but younger than 26
1-22     years of age, the department shall send in an electronic format to
1-23     the United States Selective Service System the information from the
1-24     application necessary to register the applicant under the Military
 2-1     Selective Service Act (50 U.S.C. App. Section 451 et seq.), as
 2-2     amended, including the applicant's social security number.  The
 2-3     department may not issue an original, renewal, or duplicate
 2-4     driver's license to the applicant if the applicant does not submit
 2-5     the necessary information.
 2-6           (b)  Before accepting an application from an applicant to
 2-7     which this section applies, the department shall notify the
 2-8     applicant that the application for a driver's license also
 2-9     constitutes registration with the Selective Service System for
2-10     persons who are subject to registration and who have not previously
2-11     registered.  The applicant's submission of application following
2-12     this notification constitutes the applicant's consent to the
2-13     sending of the information, including the applicant's social
2-14     security number, and to the registration.
2-15           (c)  In addition to the notification required by Subsection
2-16     (b), the department may conspicuously post at each location where
2-17     applications for driver's licenses are accepted one or more signs,
2-18     in English and Spanish, providing the information contained in the
2-19     notification.
2-20           SECTION 3.  This Act takes effect September 1, 2001, and
2-21     applies only to an application submitted on or after that date.
