1-1                                   AN ACT
 1-2     relating to registration with the Selective Service System of
 1-3     certain applicants for a driver's license.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 521.044(a), Transportation Code, is
 1-6     amended to read as follows:
 1-7           (a)  Information provided on a driver's license application
 1-8     that relates to the applicant's social security number may be used
 1-9     only by the department or disclosed only to:
1-10                 (1)  the child support enforcement division of the
1-11     attorney general's office;  [or]
1-12                 (2)  another state entity responsible for enforcing the
1-13     payment of child support; or
1-14                 (3)  the United States Selective Service System as
1-15     provided by Section 521.147.
1-16           SECTION 2.  Subchapter G, Chapter 521, Transportation Code,
1-17     is amended by adding Section 521.147 to read as follows:
1-18           Sec. 521.147.  OPTIONAL REGISTRATION WITH SELECTIVE SERVICE
1-19     SYSTEM.  (a)  The department shall develop by rule a selective
1-20     service consent statement as a part of the application for an
1-21     original, renewal, or duplicate driver's license or personal
1-22     identification certificate.  The consent statement must include a
1-23     place to indicate consent or declination to register with the
1-24     United States Selective Service System and must state the benefits
 2-1     and penalties associated with consent or declination to register.
 2-2     The department shall present the statement to each applicant who is
 2-3     subject to registration with the Selective Service System and
 2-4     record the applicant's response.  A response is required to
 2-5     complete the application for a license or certificate for such an
 2-6     applicant. The department shall forward to the Selective Service
 2-7     System, in an electronic format, only the information necessary for
 2-8     registration of an applicant consenting to registration.
 2-9           (b)  In addition to the statement required by Subsection (a),
2-10     the department may conspicuously post at each location where
2-11     applications for driver's licenses are accepted one or more signs,
2-12     in English and Spanish, providing the information contained in the
2-13     statement.
2-14           SECTION 3.  This Act takes effect September 1, 2001, and
2-15     applies only to an application submitted on or after that date.
