 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to registration with the Selective Service System of
1-11     certain applicants for a driver's license.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1. Section 521.044(a), Transportation Code, is
1-14     amended to read as follows:
1-15           (a)  Information provided on a driver's license application
1-16     that relates to the applicant's social security number may be used
1-17     only by the department or disclosed only to:
1-18                 (1)  the child support enforcement division of the
1-19     attorney general's office;  [or]
1-20                 (2)  another state entity responsible for enforcing the
1-21     payment of child support; or
1-22                 (3)  the United States Selective Service System as
1-23     provided by Section 521.147.
1-24           SECTION 2.  Subchapter G, Chapter 521, Transportation Code,
1-25     is amended by adding Section 521.147 to read as follows:
1-26           Sec. 521.147.  OPTIONAL REGISTRATION WITH SELECTIVE SERVICE
1-27     SYSTEM.  (a)  The department shall develop by rule a selective
1-28     service consent statement as a part of the application for an
1-29     original, renewal, or duplicate driver's license or personal
1-30     identification certificate.  The consent statement must include a
1-31     place to indicate consent or declination to register with the
1-32     United States Selective Service System and must state the benefits
1-33     and penalties associated with consent or declination to register.
1-34     The department shall present the statement to each applicant who is
1-35     subject to registration with the Selective Service System and
1-36     record the applicant's response.  A response is required to
1-37     complete the application for a license or certificate for such an
1-38     applicant. The department shall forward to the Selective Service
1-39     System, in an electronic format, only the information necessary for
1-40     registration of an applicant consenting to registration.
1-41           (b)  In addition to the statement required by Subsection (a),
1-42     the department may conspicuously post at each location where
1-43     applications for driver's licenses are accepted one or more signs,
1-44     in English and Spanish, providing the information contained in the
1-45     statement.
1-46           SECTION 3.  This Act takes effect September 1, 2001, and
1-47     applies only to an application submitted on or after that date.
