No. 120 1-2 (In the Senate - Received from the House March 15, 2001; 1-3 March 19, 2001, read first time and referred to Committee on 1-4 Education; April 17, 2001, reported favorably by the following 1-5 vote: Yeas 8, Nays 0; April 17, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to student intercollegiate athletic fees at The University 1-9 of Texas of the Permian Basin. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter E, Chapter 54, Education Code, is 1-12 amended by adding Section 54.5331 to read as follows: 1-13 Sec. 54.5331. INTERCOLLEGIATE ATHLETIC FEE; THE UNIVERSITY 1-14 OF TEXAS OF THE PERMIAN BASIN. (a) The board of regents of The 1-15 University of Texas System may impose a mandatory intercollegiate 1-16 athletics fee at The University of Texas of the Permian Basin if 1-17 the fee is approved by a majority vote of the students 1-18 participating in a general student election held for that purpose. 1-19 The amount of the fee may not exceed $5 per semester credit hour 1-20 for each regular semester in the first academic year in which the 1-21 fee is imposed. 1-22 (b) The amount of the fee per semester credit hour may be 1-23 increased from one academic year to the next only if the increase 1-24 is approved by a majority vote of the students of the university 1-25 participating in a general student election held for that purpose. 1-26 (c) The board of regents may prorate the amount of the fee 1-27 for a summer session. 1-28 (d) The fee imposed under this section is in addition to any 1-29 other fee authorized by law and may not be considered in 1-30 determining the maximum student services fees that may be imposed 1-31 under Section 54.503. 1-32 (e) If a mandatory intercollegiate athletics fee in an 1-33 amount within the limit provided by Subsection (a) was approved by 1-34 a majority vote of the students of the university participating in 1-35 a general student election held on or after January 1, 2000, the 1-36 board of regents may impose the fee without calling an additional 1-37 election under Subsection (a). This subsection expires January 1, 1-38 2003. 1-39 SECTION 2. This Act takes effect immediately if it receives 1-40 a vote of two-thirds of all the members elected to each house, as 1-41 provided by Section 39, Article III, Texas Constitution. If this 1-42 Act does not receive the vote necessary for immediate effect, this 1-43 Act takes effect on the 91st day after the last day of the 1-44 legislative session.
