A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to ethical standards for persons licensed by the
1-3 Commission on Law Enforcement Officer Standards and Education.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 1701.151, Occupations Code, is amended to
1-6 read as follows:
1-7 Sec. 1701.151. GENERAL POWERS AND DUTIES OF COMMISSION;
1-8 RULEMAKING AUTHORITY. (a) The commission may:
1-9 (1) adopt rules for the administration of this chapter
1-10 and for the commission's internal management and control;
1-11 (2) establish minimum standards relating to competence
1-12 and reliability, including education, training, physical, mental,
1-13 and moral standards, for licensing as an officer, county jailer, or
1-14 public security officer;
1-15 (3) report to the governor and legislature on the
1-16 commission's activities, with recommendations on matters under the
1-17 commission's jurisdiction, and make other reports that the
1-18 commission considers desirable;
1-19 (4) require a state agency or a county, special
1-20 district, or municipality in this state that employs officers or
1-21 county jailers to submit reports and information;
1-22 (5) contract as the commission considers necessary for
1-23 services, facilities, studies, and reports required for:
1-24 (A) cooperation with municipal, county, special
2-1 district, state, and federal law enforcement agencies in training
2-2 programs; and
2-3 (B) performance of the commission's other
2-4 functions; and
2-5 (6) conduct research and stimulate research by public
2-6 and private agencies to improve law enforcement and police
2-7 administration.
2-8 (b) The commission shall adopt and publish a code of ethics
2-9 for officers, county jailers, and public security officers.
2-10 SECTION 2. Section 1701.501(a), Occupations Code, is amended
2-11 to read as follows:
2-12 (a) The commission shall revoke or suspend a license, place
2-13 on probation a person whose license has been suspended, or
2-14 reprimand a license holder for a violation of this chapter, [or] a
2-15 commission rule, or the code of ethics adopted by the commission.
2-16 SECTION 3. This Act takes effect immediately if it receives
2-17 a vote of two-thirds of all the members elected to each house, as
2-18 provided by Section 39, Article III, Texas Constitution. If this
2-19 Act does not receive the vote necessary for immediate effect, this
2-20 Act takes effect September 1, 2001.
