1-1                                   AN ACT
 1-2     relating to the membership of a local workforce development board.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Section 2308.251, Government Code, is amended to
 1-5     read as follows:
 1-6           Sec. 2308.251.  DEFINITIONS [DEFINITION]. In this subchapter:
 1-7                 (1)  "Board" [, "board"] means a local workforce
 1-8     development board.
 1-9                 (2)  "Veteran" means a person who:
1-10                       (A)  has served in:
1-11                             (i)  the army, navy, air force, coast
1-12     guard, or marine corps of the United States or the United States
1-13     Public Health Service under 42 U.S.C. Section 201 et seq., as
1-14     amended;
1-15                             (ii)  the state military forces as defined
1-16     by Section 431.001; or
1-17                             (iii)  an auxiliary service of one of those
1-18     branches of the armed forces; and
1-19                       (B)  has been honorably discharged from the
1-20     branch of the service in which the person served.
1-21           SECTION 2. Section 2308.256, Government Code, is amended by
1-22     adding Subsection (h) to read as follows:
1-23           (h)  At least one of the members of a board appointed under
1-24     Subsection (a) must be a veteran who meets the qualifications
 2-1     required for the member under that subsection.
 2-2           SECTION 3. (a)  This Act takes effect September 1, 2001.
 2-3           (b)  The change in law made by this Act applies to a local
 2-4     workforce development board created on or after the effective date
 2-5     of this Act.  The chief elected officials responsible for
 2-6     appointing members to a local workforce development board created
 2-7     before the effective date of this Act shall appoint new members to
 2-8     the board that reflect the requirements of this Act as vacancies
 2-9     occur on the board or as the terms of members serving on the board
2-10     on or before the effective date of this Act expire.
2-11           (c)  If the change in law made by this Act by the addition of
2-12     Section 2308.256(h), Government Code, conflicts with federal law or
2-13     would have the effect of invalidating a waiver granted under
2-14     federal law, Section 2308.256(h), Government Code, shall be of no
2-15     effect.
