 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the membership of a local workforce development board.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1. Section 2308.251, Government Code, is amended to
1-11     read as follows:
1-12           Sec. 2308.251.  DEFINITIONS [DEFINITION]. In this subchapter:
1-13                 (1)  "Board" [, "board"] means a local workforce
1-14     development board.
1-15                 (2)  "Veteran" means a person who:
1-16                       (A)  has served in:
1-17                             (i)  the army, navy, air force, coast
1-18     guard, or marine corps of the United States or the United States
1-19     Public Health Service under 42 U.S.C. Section 201 et seq., as
1-20     amended;
1-21                             (ii)  the state military forces as defined
1-22     by Section 431.001; or
1-23                             (iii)  an auxiliary service of one of those
1-24     branches of the armed forces; and
1-25                       (B)  has been honorably discharged from the
1-26     branch of the service in which the person served.
1-27           SECTION 2. Section 2308.256, Government Code, is amended by
1-28     adding Subsection (h) to read as follows:
1-29           (h)  At least one of the members of a board appointed under
1-30     Subsection (a) must be a veteran who meets the qualifications
1-31     required for the member under that subsection.
1-32           SECTION 3. (a)  This Act takes effect September 1, 2001.
1-33           (b)  The change in law made by this Act applies to a local
1-34     workforce development board created on or after the effective date
1-35     of this Act.  The chief elected officials responsible for
1-36     appointing members to a local workforce development board created
1-37     before the effective date of this Act shall appoint new members to
1-38     the board that reflect the requirements of this Act as vacancies
1-39     occur on the board or as the terms of members serving on the board
1-40     on or before the effective date of this Act expire.
1-41           (c)  If the change in law made by this Act by the addition of
1-42     Section 2308.256(h), Government Code, conflicts with federal law or
1-43     would have the effect of invalidating a waiver granted under
1-44     federal law, Section 2308.256(h), Government Code, shall be of no
1-45     effect.
