1-7 A BILL TO BE ENTITLED
1-8 AN ACT
1-9 relating to exempting members of the armed forces from the Texas
1-10 Academic Skills Program.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Section 51.306(r), Education Code, is amended to
1-13 read as follows:
1-14 (r) This section does not apply to:
1-15 (1) a student who accumulated three or more
1-16 college-level semester credit hours prior to the 1989 fall
1-17 semester;
1-18 (2) a student located outside this state who enrolls
1-19 in a course offered outside this state by an institution of higher
1-20 education;
1-21 (3) a deaf student;
1-22 (4) a student who has graduated with a baccalaureate
1-23 degree from an institution of higher education, an accredited
1-24 private or independent institution of higher education, or an
1-25 accredited out-of-state institution of higher education;
1-26 (5) a student enrolled in a certificate program at a
1-27 community or technical college of one year or less; [or]
1-28 (6) a student who is a citizen of a country other than
1-29 the United States and is not seeking a degree; or
1-30 (7) a student who is serving on active duty as a
1-31 member of the armed forces of the United States.
1-32 SECTION 2. Section 51.3061(g), Education Code, is amended to
1-33 read as follows:
1-34 (g) This section does not apply to a student who is:
1-35 (1) enrolled in a certificate program of one year or
1-36 less; or
1-37 (2) serving on active duty as a member of the armed
1-38 forces of the United States.
1-39 SECTION 3. This Act takes effect immediately and applies
1-40 beginning with the 2001 fall semester.
