1-1                                   AN ACT
 1-2     relating to the conveyance of certain state property.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  (a)  Not later than January 31, 2002, the Texas
 1-5     Board of Criminal Justice shall convey to the Board of Regents of
 1-6     the Texas State University System for use by Sam Houston State
 1-7     University the real property described by Subsection (e) of this
 1-8     section.
 1-9           (b)  The Texas Board of Criminal Justice shall convey the
1-10     property by deed without warranty regarding covenants of title.
1-11           (c)  The deed must include a provision that:
1-12                 (1)  requires Sam Houston State University to use the
1-13     property for a governmental purpose; and
1-14                 (2)  indicates that title to the property will
1-15     automatically revert to the Texas Board of Criminal Justice if Sam
1-16     Houston State University fails to use the property for a
1-17     governmental purpose.
1-18           (d)  The Texas Board of Criminal Justice shall retain custody
1-19     of the deed after the deed is filed in the real property records of
1-20     Walker County.
1-21           (e)  The real property referred to in this section is
1-22     described as follows:
1-23     Being an 345.58 acre tract of land located in the John Porter
1-24     Survey, Abstract 38, Walker County, Texas, and being a portion of a
 2-1     residue of 1664.85 acres of land conveyed in deed from Albert E.
 2-2     Cunningham and wife, Julia S. Cunningham to the State of Texas for
 2-3     the Texas Department of Corrections, dated November 10, 1959, and
 2-4     recorded in the Deed Records of Walker County in Volume 165, Page
 2-5     138; said 345.58 acre tract being more particularly described by
 2-6     metes and bounds as follows:
 2-7     BEGINNING at a concrete TxDOT monument found for the most westerly
 2-8     cutback corner of the intersection of the northeasterly right of
 2-9     way line of FM (Farm to Market) 980, based on a width of 80.00
2-10     feet, recorded in Volume 129, Page 236, of the Deed Records of
2-11     Walker County, and the northwesterly right of way line of SH (State
2-12     Highway) 19, based on a width of 230.00 feet, and having grid
2-13     coordinates of X= 3842823.28, Y= 10308432.06; all bearings and
2-14     coordinates are based on the Texas State Plane Coordinate System,
2-15     Central Zone, NAD 83, Adj. 1993.  To convert to surface
2-16     coordinates, divide by a combined scale factor of 0.99988; NGS
2-17     Station BL 2006 bears South 34 17'48" East, a grid distance of
2-18     5280.90 feet.
2-19     THENCE, North 48 15'45" West, along the northeasterly right of way
2-20     line of FM 980, a distance of 1086.25 feet to a 5/8-inch iron rod
2-21     set for an angle point;
2-22     THENCE, North 49 54'44" West, continuing along the northeasterly
2-23     right of way line of FM 980, a distance of 1312.47 feet to a
2-24     5/8-inch iron rod set for a point of curvature;
2-25     THENCE, in a northwesterly direction, continuing along the
2-26     northeasterly right of way line of FM 980, with a curve to the
2-27     left, having a central angle of 02 55'23", a radius of 5769.58
 3-1     feet, an arc length of 294.34 feet, and a chord bearing of North
 3-2     51 22'25" West, a distance of 294.31 feet to a 5/8-inch iron rod
 3-3     set for the point of tangency;
 3-4     THENCE, North 52 50'07" West, continuing along the northeasterly
 3-5     right of way line of FM 980, a distance of 630.14 feet to a
 3-6     5/8-inch iron rod set for a point of curvature;
 3-7     THENCE, in a northwesterly direction, continuing along the
 3-8     northeasterly right of way line of FM 980, with a curve to the
 3-9     left, having a central angle of 06 37'26", a radius of 994.93 feet,
3-10     an arc length of 115.02 feet, and a chord bearing of North
3-11     56 08'50" West, a distance of 114.96 feet to a 5/8-inch iron rod
3-12     set in the southeast line of that certain tract of land as conveyed
3-13     in deed to Horace M. Reeves and Mary Frances Reeves, dated December
3-14     16, 1993, and recorded in Volume 211, Page 629 of the Official
3-15     Public Records of Walker County;
3-16     THENCE, North 14 38'33" West, along the easterly line of said
3-17     Reeves tract, a distance of 186.96 feet to a fence corner for the
3-18     northeast corner of said Reeves tract;
3-19     THENCE, North 64 58'09" West, along the northerly line of said
3-20     Reeves tract and a fence line, a distance of 236.19 feet to a
3-21     3-inch iron pipe found in the southerly line of a residue of 100
3-22     acres of land conveyed in deed to Sam W. Robbins, dated August 30,
3-23     1947, and recorded in Volume 120, Page 310, of the Deed Records of
3-24     Walker County;
3-25     THENCE, North 42  10'24" East, along the southerly line of said
3-26     Robbins tract and a fence line, a distance of 2439.03 feet to a
3-27     2-inch iron pipe found for the southeast corner of a residue of 100
 4-1     acres of land conveyed in deed to Phillip M. Campbell, et al, dated
 4-2     May 9, 1985, and recorded in Volume 445, Page 408 of the Official
 4-3     Public Records of Walker County;
 4-4     THENCE, North 47  35'56" West, along the easterly line of said
 4-5     Phillip M. Campbell, et al tract and a fence line, a distance of
 4-6     3064.51 feet the Livingston Reservoir Pool Line, as described in
 4-7     deed to the Trinity River Authority, dated August 26, 1969, and
 4-8     recorded in Volume 223, Page 758 of the Deed Records of Walker
 4-9     County:

7-23     13.462 acre tract and a fence line, a distance of 611.66 feet to a
7-24     5/8-inch iron rod set in the northwesterly right of way line of SH
7-25     19;
7-26     THENCE, South 30 06'27" West, along the northwesterly right of way
7-27     line of SH 19, a distance of 575.88 feet to a 5/8-inch iron rod set
 8-1     for the most easterly cutback corner of the intersection with FM
 8-2     980;
 8-3     THENCE, South 68 26'42" West, along said cutback corner, a distance
 8-4     of 162.00 feet to the POINT OF BEGINNING and containing 345.58
 8-5     acres of land.
 8-6           SECTION 2.  This Act takes effect immediately if it receives
 8-7     a vote of two-thirds of all the members elected to each house, as
 8-8     provided by Section 39, Article III, Texas Constitution.  If this
 8-9     Act does not receive the vote necessary for immediate effect, this
8-10     Act takes effect September 1, 2001.
