No. 266 77R2050 PAM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transfer of certain state property from the Texas 1-3 Department of Criminal Justice to the Board of Regents of the Texas 1-4 State University System. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. (a) Not later than January 31, 2002, the Texas 1-7 Department of Criminal Justice shall transfer to the Board of 1-8 Regents of the Texas State University System for use by Sam Houston 1-9 State University the real property described by Subsection (e) of 1-10 this section. 1-11 (b) The Texas Department of Criminal Justice shall transfer 1-12 the property by an appropriate instrument of transfer. 1-13 (c) The instrument of transfer must include a provision 1-14 that: 1-15 (1) requires Sam Houston State University to use the 1-16 property in a manner that primarily promotes a governmental 1-17 purpose; and 1-18 (2) indicates that ownership of the property will 1-19 automatically revert to the Texas Department of Criminal Justice if 1-20 Sam Houston State University fails to use the property in that 1-21 manner. 1-22 (d) The Texas Department of Criminal Justice shall retain 1-23 custody of the instrument of transfer after the instrument of 1-24 transfer is filed in the real property records of Walker County. 2-1 (e) The real property referred to in this section is 2-2 described as follows: 2-3 Being an 345.58 acre tract of land located in the John Porter 2-4 Survey, Abstract 38, Walker County, Texas, and being a portion of a 2-5 residue of 1664.85 acres of land conveyed in deed from Albert E. 2-6 Cunningham and wife, Julia S. Cunningham to the State of Texas for 2-7 the Texas Department of Corrections, dated November 10, 1959, and 2-8 recorded in the Deed Records of Walker County in Volume 165, Page 2-9 138; said 345.58 acre tract being more particularly described by 2-10 metes and bounds as follows: 2-11 BEGINNING at a concrete TxDOT monument found for the most westerly 2-12 cutback corner of the intersection of the northeasterly right of 2-13 way line of FM (Farm to Market) 980, based on a width of 80.00 2-14 feet, recorded in Volume 129, Page 236, of the Deed Records of 2-15 Walker County, and the northwesterly right of way line of SH (State 2-16 Highway) 19, based on a width of 230.00 feet, and having grid 2-17 coordinates of X= 3842823.28, Y= 10308432.06; all bearings and 2-18 coordinates are based on the Texas State Plane Coordinate System, 2-19 Central Zone, NAD 83, Adj. 1993. To convert to surface 2-20 coordinates, divide by a combined scale factor of 0.99988; NGS 2-21 Station BL 2006 bears South 3417'48" East, a grid distance of 2-22 5280.90 feet. 2-23 THENCE, North 4815'45" West, along the northeasterly right of way 2-24 line of FM 980, a distance of 1086.25 feet to a 5/8-inch iron rod 2-25 set for an angle point; 2-26 THENCE, North 4954'44" West, continuing along the northeasterly 2-27 right of way line of FM 980, a distance of 1312.47 feet to a 3-1 5/8-inch iron rod set for a point of curvature; 3-2 THENCE, in a northwesterly direction, continuing along the 3-3 northeasterly right of way line of FM 980, with a curve to the 3-4 left, having a central angle of 0255'23", a radius of 5769.58 feet, 3-5 an arc length of 294.34 feet, and a chord bearing of North 5122'25" 3-6 West, a distance of 294.31 feet to a 5/8-inch iron rod set for the 3-7 point of tangency; 3-8 THENCE, North 5250'07" West, continuing along the northeasterly 3-9 right of way line of FM 980, a distance of 630.14 feet to a 3-10 5/8-inch iron rod set for a point of curvature; 3-11 THENCE, in a northwesterly direction, continuing along the 3-12 northeasterly right of way line of FM 980, with a curve to the 3-13 left, having a central angle of 0637'26", a radius of 994.93 feet, 3-14 an arc length of 115.02 feet, and a chord bearing of North 5608'50" 3-15 West, a distance of 114.96 feet to a 5/8-inch iron rod set in the 3-16 southeast line of that certain tract of land as conveyed in deed to 3-17 Horace M. This Act takes effect immediately if it receives 8-11 a vote of two-thirds of all the members elected to each house, as 8-12 provided by Section 39, Article III, Texas Constitution. If this 8-13 Act does not receive the vote necessary for immediate effect, this 8-14 Act takes effect September 1, 2001.
