 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the conveyance of certain state property.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  (a)  Not later than January 31, 2002, the Texas
1-13     Board of Criminal Justice shall convey to the Board of Regents of
1-14     the Texas State University System for use by Sam Houston State
1-15     University the real property described by Subsection (e) of this
1-16     section.
1-17           (b)  The Texas Board of Criminal Justice shall convey the
1-18     property by deed without warranty regarding covenants of title.
1-19           (c)  The deed must include a provision that:
1-20                 (1)  requires Sam Houston State University to use the
1-21     property for a governmental purpose; and
1-22                 (2)  indicates that title to the property will
1-23     automatically revert to the Texas Board of Criminal Justice if Sam
1-24     Houston State University fails to use the property for a
1-25     governmental purpose.
1-26           (d)  The Texas Board of Criminal Justice shall retain custody
1-27     of the deed after the deed is filed in the real property records of
1-28     Walker County.
1-29           (e)  The real property referred to in this section is
1-30     described as follows:
1-31     Being an 345.58 acre tract of land located in the John Porter
1-32     Survey, Abstract 38, Walker County, Texas, and being a portion of a
1-33     residue of 1664.85 acres of land conveyed in deed from Albert E.
1-34     Cunningham and wife, Julia S. Cunningham to the State of Texas for
1-35     the Texas Department of Corrections, dated November 10, 1959, and
1-36     recorded in the Deed Records of Walker County in Volume 165, Page
1-37     138; said 345.58 acre tract being more particularly described by
1-38     metes and bounds as follows:  BEGINNING at a concrete TxDOT
1-39     monument found for the most westerly cutback corner of the
1-40     intersection of the northeasterly right of way line of FM (Farm to
1-41     Market) 980, based on a width of 80.00 feet, recorded in Volume
1-42     129, page 236, of the Deed Records of Walker County, and the
1-43     northwesterly right of way line of SH (State Highway) 19, based on
1-44     a width of 230.00 feet, and having grid coordinates of X=
1-45     3842823.28, Y= 10308432.06; all bearings and coordinates are based
1-46     on the Texas State Plane Coordinate System, Central Zone, NAD 83,
1-47     Adj. 1993.  To convert to surface coordinates, divide by a combined
1-48     scale factor of 0.99988; NGS Station BL2006 bears South 34 17'48"
1-49     East, a grid distance of 5280.90 feet.
1-50     THENCE, North 48 15'45" West, along the northeasterly right of way
1-51     line of FM 980, a distance of 1086.25 feet to a 5/8-inch iron rod
1-52     set for an angle point;
1-53     THENCE, North 49 54'44" West, continuing along the northeasterly
1-54     right of way line of FM 980, a distance of 1312.47 feet to a
1-55     5/8-inch iron rod set for a point of curvature;
1-56     THENCE, in a northwesterly direction, continuing along the
1-57     northeasterly right of way line of FM 980, with a curve to the
1-58     left, having a central angle of 02 55'23", a radius of 5769.58
1-59     feet, an arc length of 294.34 feet, and a chord bearing of North
1-60     51 22'25" West, a distance of 294.31 feet to a 5/8-inch iron rod
1-61     set for the point of tangency;
1-62     THENCE, North 52 50'07" West, continuing along the northeasterly
1-63     right of way line of FM 980, a distance of 630.14 feet to a
1-64     5/8-inch iron rod set for a point of curvature;
 2-1     THENCE, in a northwesterly direction, continuing along the
 2-2     northeasterly right of way line of FM 980, with a curve to the
 2-3     left, having a central angle of 06 37'26", a radius of 994.93 feet,
 2-4     an arc length of 115.02 feet, and a chord bearing of North
 2-5     56 08'50" West, a distance of 114.96 feet to a 5/8-inch iron rod
 2-6     set in the southeast line of that certain tract of land as conveyed
 2-7     in deed to Horace M. Reeves and Mary Frances Reeves, dated December

2-11     Reeves tract, a distance of 186.96 feet to a fence corner for the
2-12     northeast corner of said Reeves tract;
2-13     THENCE, North 64 58'09" West, along the northerly line of said
2-14     Reeves tract and a fence line, a distance of 236.19 feet to a
2-15     3-inch iron pipe found in the southerly line of a residue of 100
2-16     acres of land conveyed in deed to Sam W. Robbins, dated August 30,
2-17     1947, and recorded in Volume 120, Page 310, of the Deed Records of
2-18     Walker County;
2-19     THENCE, North 42 10'24" East, along the southerly line of said
2-20     Robbins tract and a fence line, a distance of 2439.03 feet to a
2-21     2-inch iron pipe found for the southeast corner of a residue of 100
2-22     acres of land conveyed in deed to Phillip M. Campbell, et al, dated
2-23     May 9, 1985, and recorded in Volume 445, Page 408 of the Official

3-60     line of SH 19, a distance of 575.88 feet to a 5/8-inch iron rod set
3-61     for the most easterly cutback corner of the intersection with FM
3-62     980;
3-63     THENCE, South 68 26'42" West, along said cutback corner, a distance
3-64     of 162.00 feet to the POINT OF BEGINNING and containing 345.58
3-65     acres of land.
3-66           SECTION 2.  (a)  The Texas Board of Criminal Justice shall
3-67     sell to the Texas Parks and Wildlife Department the tract of land
3-68     associated with the Retrieve Unit of the Texas Board of Criminal
3-69     Justice in Brazoria County.
 4-1           (b)  The Texas Parks and Wildlife Department shall purchase
 4-2     the land at fair market value.
 4-3           (c)  PROCEEDS.  The proceeds from the sale of the property
 4-4     required by Section 2 of this Act shall be provided to the Texas
 4-5     Board of Criminal Justice.
 4-6           SECTION 3.  This Act takes effect immediately if it receives
 4-7     a vote of two-thirds of all the members elected to each house, as
 4-8     provided by Section 39, Article III, Texas Constitution.  If this
 4-9     Act does not receive the vote necessary for immediate effect, this
4-10     Act takes effect September 1, 2001.
