By King of Parker H.B. No. 285 77R224 KEL-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the authority of a county or school district to sell 1-3 land to certain organizations that provide low-income housing or 1-4 promote revitalization of the land. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 34.015, Tax Code, as amended by Chapters 1-7 181 and 817, Acts of the 76th Legislature, Regular Session, 1999, 1-8 is reenacted and amended to read as follows: 1-9 Sec. 34.015. ALTERNATE MANNER OF SALE. (a) Notwithstanding 1-10 any other provision of this subchapter, the governing body of a 1-11 municipality, county, or school district may provide for the manner 1-12 in which any land acquired by the municipality, county, or school 1-13 district may be sold if the land is sold to: 1-14 (1) a nonprofit organization that develops housing for 1-15 low income individuals and families as a primary activity to 1-16 promote community-based revitalization of the municipality, county, 1-17 or school district; 1-18 (2) a nonprofit corporation described by 26 U.S.C. 1-19 Section 501(c)(3) that: 1-20 (A) has been incorporated in this state for at 1-21 least one year; 1-22 (B) has a corporate purpose to develop 1-23 affordable housing that is stated in its articles of incorporation, 1-24 bylaws, or charter; 2-1 (C) has at least one-fourth of its board of 2-2 directors residing in the municipality, county, or school district; 2-3 and 2-4 (D) engages primarily in the building, repair, 2-5 rental, or sale of housing for low income individuals and families; 2-6 or 2-7 (3) a religious organization that: 2-8 (A) owns other property located in the 2-9 municipality, county, or school district that is exempt from 2-10 taxation under Section 11.20; and 2-11 (B) has entered into a written agreement with 2-12 the municipality, county, or school district regarding the 2-13 revitalization of the land. 2-14 (b) A municipality, county, or school district operating 2-15 under this section may by ordinance, order, or resolution, as 2-16 appropriate, determine the individuals and families who qualify as 2-17 low income individuals and families under Subsection (a)(1) or (2). 2-18 In adopting an ordinance, order, or resolution under this 2-19 subsection, the municipality, county, or school district shall 2-20 consider median income of individuals and median family income in 2-21 the area. 2-22 SECTION 2. This Act takes effect September 1, 2001.
