                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to creating the criminal offense of providing a tobacco
 1-3     product to an inmate of the Texas Department of Criminal Justice.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 38.11(a), Penal Code, is amended to read
 1-6     as follows:
 1-7           (a)  A person commits an offense if the person provides:
 1-8                 (1)  an alcoholic beverage, controlled substance, or
 1-9     dangerous drug to an inmate of a correctional facility, except on
1-10     the prescription of a physician; or
1-11                 (2)  a tobacco product to an inmate of a correctional
1-12     facility operated by or operated under contract with the Texas
1-13     Department of Criminal Justice.
1-14           SECTION 2. Section 38.11(f), Penal Code, is amended by adding
1-15     Subdivision (3) to read as follows:
1-16                 (3)  "Tobacco product" has the meaning assigned by
1-17     Section 155.001, Tax Code.
1-18           SECTION 3. This Act takes effect September 1, 2001.
