                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a premium discount on a motor vehicle insurance policy
 1-3     for completion of a driving safety course taken for the purpose of
 1-4     dismissing a traffic offense.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Article 45.0511, Code of Criminal Procedure, is
 1-7     amended by adding Subsection (r) to read as follows:
 1-8           (r)  An insurer that delivers or issues for delivery in this
 1-9     state a motor vehicle insurance policy to a person against whom a
1-10     charge is dismissed under this article is not required to offer a
1-11     premium discount on the policy for completion of the driving safety
1-12     course that is the subject of the certificate of completion
1-13     accepted by the court under Subsection (l).
1-14           SECTION 2. This Act takes effect September 1, 2001, and
1-15     applies only to an insurance policy that is delivered, issued for
1-16     delivery, or renewed on or after that date.  A policy that is
1-17     delivered, issued for delivery, or renewed before the effective
1-18     date of this Act is governed by the law in effect on the date the
1-19     insurance policy was delivered, issued for delivery, or renewed,
1-20     and the former law is continued in effect for that purpose.
