                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to exempting certain entities from fees charged for
 1-3     processing inquiries for criminal history information.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 411.088(a), Government Code, is amended
 1-6     to read as follows:
 1-7           (a)  The department may charge a person other than [that is
 1-8     not primarily] a political subdivision of this state, an [criminal
 1-9     justice] agency of this state, an agency of the federal government,
1-10     or a nonprofit corporation a fee for processing inquiries for
1-11     criminal history record information. The department may charge:
1-12                 (1)  a fee of $10 for each inquiry for criminal history
1-13     record information on a person that is processed only on the basis
1-14     of the person's name, unless the inquiry is submitted
1-15     electronically or by magnetic media, in which event the fee is $1;
1-16                 (2)  a fee of $15 for each inquiry for criminal history
1-17     record information on a person that is processed on the basis of a
1-18     fingerprint comparison search; and
1-19                 (3)  except as provided by Subsection (b), actual costs
1-20     for processing all other information inquiries.
1-21           SECTION 2.  This Act takes effect September 1, 2001.
