1-1                                   AN ACT
 1-2     relating to human donor milk banks.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Chapter 161, Health and Safety Code, is amended by
 1-5     adding Subchapter G to read as follows:
 1-6                       SUBCHAPTER G.  HUMAN MILK BANKS
 1-7           Sec. 161.071.  MINIMUM GUIDELINES FOR HUMAN DONOR MILK BANKS.
 1-8     The department shall establish minimum guidelines for the
 1-9     procurement, processing, distribution, or use of human milk by
1-10     donor milk banks.
1-11           SECTION 2. If before implementing any provision of this Act a
1-12     state agency determines that a waiver or authorization from a
1-13     federal agency is necessary for implementation of that provision,
1-14     the agency affected by the provision shall request the waiver or
1-15     authorization and may delay implementing that provision until the
1-16     waiver or authorization is granted.
1-17           SECTION 3. This Act takes effect September 1, 2001.
