                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the applicability of municipal zoning ordinances to
 1-3     open-enrollment charter schools.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 12.103, Education Code, is amended to read
 1-6     as follows:
 1-7           Sec. 12.103.  APPLICABILITY OF LAWS, [AND] RULES, AND
 1-8     ORDINANCES TO OPEN-ENROLLMENT CHARTER SCHOOL. An open-enrollment
 1-9     charter school is subject to federal and state laws and rules
1-10     governing public schools and to municipal zoning ordinances, except
1-11     that an open-enrollment charter school is subject to this code and
1-12     rules adopted under this code only to the extent the applicability
1-13     to an open-enrollment charter school of a provision of this code or
1-14     a rule adopted under this code is specifically provided.
1-15           SECTION 2. This Act takes effect September 1, 2001.
