                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to complaints filed with the Texas Natural Resource
 1-3     Conservation Commission.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter E, Chapter 5, Water Code, is amended by
 1-6     adding Sections 5.1771 and 5.1772 to read as follows:
 1-7           Sec. 5.1771.  COMPLAINT ASSESSMENT. (a)  The commission
 1-8     annually shall conduct a comprehensive analysis of the complaints
 1-9     it receives, including analysis by the following categories:
1-10                 (1)  air;
1-11                 (2)  water;
1-12                 (3)  waste;
1-13                 (4)  priority classification;
1-14                 (5)  region;
1-15                 (6)  commission response;
1-16                 (7)  enforcement action taken; and
1-17                 (8)  trends by complaint type.
1-18           (b)  In addition to the analysis required by Subsection (a),
1-19     the commission shall assess the impact of changes made in the
1-20     commission's complaint policy.
1-21           Sec. 5.1772.  COORDINATION WITH LOCAL OFFICIALS. When
1-22     investigating complaints the commission shall make reasonable
1-23     efforts to work with local officials from the area that is the
1-24     subject of the complaint.
 2-1           SECTION 2. Section 5.178(b), Water Code, is amended to read
 2-2     as follows:
 2-3           (b)  The report due by December 1 of an even-numbered year
 2-4     shall include, in addition:
 2-5                 (1)  the commission's recommendations for necessary and
 2-6     desirable legislation; and
 2-7                 (2)  the following reports:
 2-8                       (A)  the assessments and reports required by
 2-9     Sections 361.0219(c), 361.0232, [361.485,] 361.510, 371.063, and
2-10     382.141, Health and Safety Code; [and]
2-11                       (B)  the reports required by Section 26.0135(d)
2-12     of this code and Section 5.02, Chapter 133, Acts of the 69th
2-13     Legislature, Regular Session, 1985; and
2-14                       (C)  a summary of the analyses and assessments
2-15     required by Section 5.1771 of this code.
2-16           SECTION 3. This Act takes effect September 1, 2001.
