                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the regulation of barbers and cosmetologists at mobile
 1-3     locations.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 1601.302(b), Occupations Code, is amended
 1-6     to read as follows:
 1-7           (b)  The application must provide:
 1-8                 (1)  the permanent address of the barbershop, unless
 1-9     the barbershop is at a mobile location;
1-10                 (2)  the legal description of the premises to be
1-11     licensed; and
1-12                 (3)  other information required by the board.
1-13           SECTION 2. Section 1601.303, Occupations Code, is amended to
1-14     read as follows:
1-15           Sec. 1601.303.  ISSUANCE OF BARBERSHOP PERMIT. (a)  The board
1-16     shall issue a barbershop permit to an applicant if:
1-17                 (1)  the applicant holds a Class A barber certificate;
1-18     and
1-19                 (2)  the shop meets the minimum health standards for
1-20     barbershops set by the Texas Department of Health and the rules of
1-21     the board.
1-22           (b)  The barbershop may be at a mobile location.
1-23           SECTION 3. Section 1602.301(a), Occupations Code, is amended
1-24     to read as follows:
 2-1           (a)  A person may not operate a beauty shop, beauty culture
 2-2     school, specialty shop, or other place of business in which
 2-3     cosmetology is taught or practiced unless the person holds a
 2-4     license to operate that place of business.  The place of business
 2-5     at which cosmetology is practiced may be at a mobile location.
 2-6           SECTION 4.  This Act takes effect immediately if it receives
 2-7     a vote of two-thirds of all the members elected to each house, as
 2-8     provided by Section 39, Article III, Texas Constitution.  If this
 2-9     Act does not receive the vote necessary for immediate effect, this
2-10     Act takes effect September 1, 2001.
