A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the authority of the board of regents of the University
1-3 of North Texas to levy student fees for medical services.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 54.5081, Education Code, is amended to
1-6 read as follows:
1-7 Sec. 54.5081. MEDICAL SERVICES FEE; UNIVERSITY OF NORTH
1-8 TEXAS SYSTEM INSTITUTIONS. (a) The [governing] board of regents of
1-9 the University of North Texas System may charge each student
1-10 registered at a component institution of the University of North
1-11 Texas System [the university] a medical services fee not to exceed
1-12 $75 [$25] for each semester of the regular term or 12-week summer
1-13 session and not to exceed $37.50 [$12.50] for each six-week or
1-14 shorter term of the summer session.
1-15 (b) Before charging a medical services fee at a component
1-16 institution, the board must give students and administrators an
1-17 opportunity to offer recommendations to the board as to the type
1-18 and scope of medical services that should be provided.
1-19 (c) The board may not increase the amount of the medical
1-20 services fee charged at a component institution by more than 10
1-21 percent from one academic year to the next unless the amount of the
1-22 increase is approved by a majority of the students at the
1-23 institution voting in a general election held at the institution
1-24 for that purpose.
2-1 (d) A medical services fee charged at a component
2-2 institution of the University of North Texas System under this
2-3 section may be used only to provide medical services to students
2-4 registered at that component institution [the university].
2-5 (e) [(d)] The fee imposed under this section may not be
2-6 considered in determining the maximum student services fee that may
2-7 be charged students enrolled at a component institution of the
2-8 University of North Texas System [the university] under Section
2-9 54.503(b) [of this code].
2-10 (f) The maximum fee amounts imposed by Subsection (a) and
2-11 the prohibition imposed by Subsection (c) do not apply to the 2001
2-12 fall semester. For the 2001 fall semester, the board may not
2-13 increase the amount of the medical services fee charged at a
2-14 component institution of the University of North Texas System to an
2-15 amount more than $30 unless the increase is approved by a majority
2-16 of the students at the institution voting in an election held for
2-17 that purpose. This subsection expires January 1, 2002.
2-18 SECTION 2. The change in law made by this Act applies
2-19 beginning with fees charged for the 2001 fall semester. Fees
2-20 charged for a semester or session before the 2001 fall semester are
2-21 governed by the law in effect at the time the fees are charged, and
2-22 that law is continued in effect for that purpose.
2-23 SECTION 3. This Act takes effect immediately if it receives a
2-24 vote of two-thirds of all the members elected to each house, as
2-25 provided by Section 39, Article III, Texas Constitution. If this
2-26 Act does not receive the vote necessary for immediate effect, this
2-27 Act takes effect September 1, 2001.
